90_SB1588 720 ILCS 5/12-21.6 Amends the Criminal Code of 1961, relating to the offense of endangering the life or health of a child. Makes endangering the life of a child is a Class 3 felony for a first offense and a Class 2 felony for a second or subsequent offense. If death of the child results, it is a Class X felony. Makes endangering the health of a child is a Class A misdemeanor for a first offense and a Class 3 felony for a second or subsequent offense (now the current law for endangering either the life or health of the child). The Criminal Code of 1961 is amended by 6 changing Section 12-21.6 as follows: 7 (720 ILCS 5/12-21.6) 8 Sec. 12-21.6. Endangering the life or health of a child. 9 (a) It is unlawful for any person to willfully cause or 10 permit the lifeor healthof theachild under the age of 18 11 to be endangered or to willfully cause or permit the child to 12 be placed in circumstances that endanger the child's lifeor13health. 14 (b) It is unlawful for any person to willfully cause or 15 permit the health of the child under the age of 18 to be 16 endangered or to willfully cause or permit the child under 17 the age of 18 to be placed in circumstances that endanger the 18 child's health. 19 (c) A violation of subsection (a) of this Section is a 20Class A misdemeanor. A second or subsequent violation of21this Section is aClass 3 felony. A second or subsequent 22 violation of subsection (a) of this Section is a Class 2 23 felony. A violation of subsection (a) of this Section that 24 results in the death of the child is a Class X felony. A 25 violation of subsection (b) of this Section is a Class A 26 misdemeanor. A second or subsequent violation of subsection 27 (b) of this Section is a Class 3 felony. 28 (Source: P.A. 88-479.)
