Amends the Civil Administrative Code of Illinois.
Provides that the Department of Transportation may grant a
lease of land or property to a governmental unit for a period
of not longer than 99 years (now for a period no longer than
5 years).

1 AN ACT to amend the Civil Administrative Code of Illinois
2 by changing Section 49.13.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Civil Administrative Code of Illinois is
6 amended by changing Section 49.13 as follows:
7 (20 ILCS 2705/49.13) (from Ch. 127, par. 49.13)
8 Sec. 49.13. Lease of property.
9 (a) From time to time to lease any land or property,
10 with or without appurtenances, of which the Department has
11 jurisdiction, and which are not immediately to be used or
12 developed by the State; provided that no such lease be for a
13 longer period of time than that in which it can reasonably be
14 expected the State will not have use for such property, and
15 further provided that no such lease be for a longer period of
16 time than 5 years, except as provided in subsection (b).
17 (b) A lease that is a non-revenue lease to any other
18 department of State government, any authority, commission, or
19 agency of the State, or a municipality, county, or township
20 of the State, including in any land lease the corresponding
21 vertical rights, subterranean and air rights, and sublease
22 rights, may be for a period of time no longer than 99 years.
