90_SB1647 105 ILCS 5/2-3.62 from Ch. 122, par. 2-3.62 105 ILCS 5/13A-10 Amends the School Code. Disbands each of the 3 educational service centers in suburban Cook County on July 1, 1998, provides for assumption of their program responsibilities by the regional office of education for the educational service region in which those centers were located, and adds that the regional superintendent of schools for that educational service region shall serve as the chief administrator of all programs and services formerly provided by the 3 disbanded educational service centers. LRB9011341THpk LRB9011341THpk 1 AN ACT to amend the School Code by changing Sections 2 2-3.62 and 13A-10. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The School Code is amended by changing 6 Sections 2-3.62 and 13A-10 as follows: 7 (105 ILCS 5/2-3.62) (from Ch. 122, par. 2-3.62) 8 Sec. 2-3.62. Educational Service Centers. 9 (a) A regional network of educational service centers 10 shall be established by the State Board of Education to 11 coordinate and combine existing services in a manner which is 12 practical and efficient and to provide new services to 13 schools as provided in this Section. Services to be made 14 available by such centers shall include the planning, 15 implementation and evaluation of: 16 (1) education for gifted children through area 17 service centers, experimental projects and institutes as 18 provided in Section 14A-6; 19 (2) computer technology education including the 20 evaluation, use and application of state-of-the-art 21 technology in computer software as provided in Section 22 2-3.43; 23 (3) mathematics, science and reading resources for 24 teachers including continuing education, inservice 25 training and staff development. 26 The centers may provide training, technical assistance, 27 coordination and planning in other program areas such as 28 school improvement, school accountability, career guidance, 29 early childhood education, alcohol/drug education and 30 prevention, family life - sex education, electronic 31 transmission of data from school districts to the State, -2- LRB9011341THpk 1 alternative education and regional special education, and 2 telecommunications systems that provide distance learning. 3 Such telecommunications systems may be obtained through the 4 Department of Central Management Services pursuant to Section 5 67.18 of the Civil Administrative Code of Illinois. The 6 programs and services of educational service centers may be 7 offered to private school teachers and private school 8 students within each service center area provided public 9 schools have already been afforded adequate access to such 10 programs and services. 11 The State Board of Education shall promulgate rules and 12 regulations necessary to implement this Section. The rules 13 shall include detailed standards which delineate the scope 14 and specific content of programs to be provided by each 15 Educational Service Center, as well as the specific planning, 16 implementation and evaluation services to be provided by each 17 Center relative to its programs. The Board shall also 18 provide the standards by which it will evaluate the programs 19 provided by each Center. 20 (b) Centers serving Class 1 county school units shall be 21 governed by an 11-member board, 3 members of which shall be 22 public school teachers nominated by the local bargaining 23 representatives to the appropriate regional superintendent 24 for appointment and no more than 3 members of which shall be 25 from each of the following categories, including but not 26 limited to superintendents, regional superintendents, school 27 board members and a representative of an institution of 28 higher education. The members of the board shall be 29 appointed by the regional superintendents whose school 30 districts are served by the educational service center. The 31 composition of the board will reflect the revisions of this 32 amendatory Act of 1989 as the terms of office of current 33 members expire. 34 (c) The centers shall be of sufficient size and number -3- LRB9011341THpk 1 to assure delivery of services to all local school districts 2 in the State. 3 (d) From monies appropriated for this program the State 4 Board of Education shall provide grants to qualifying 5 Educational Service Centers applying for such grants in 6 accordance with rules and regulations promulgated by the 7 State Board of Education to implement this Section. 8 (e) The governing authority of each of the 18 regional 9 educational service centers shall appoint a family life - sex 10 education advisory board consisting of 2 parents, 2 teachers, 11 2 school administrators, 2 school board members, 2 health 12 care professionals, one library system representative, and 13 the director of the regional educational service center who 14 shall serve as chairperson of the advisory board so 15 appointed. Members of the family life - sex education 16 advisory boards shall serve without compensation. Each of 17 the advisory boards appointed pursuant to this subsection 18 shall develop a plan for regional teacher-parent family life 19 - sex education training sessions and shall file a written 20 report of such plan with the governing board of their 21 regional educational service center. The directors of each 22 of the regional educational service centers shall thereupon 23 meet, review each of the reports submitted by the advisory 24 boards and combine those reports into a single written report 25 which they shall file with the Citizens Council on School 26 Problems prior to the end of the regular school term of the 27 1987-1988 school year. 28 (f) The 14 educational service centers serving Class I 29 county school units shall be disbanded on the first Monday of 30 August, 1995, and their statutory responsibilities and 31 programs shall be assumed by the regional offices of 32 education, subject to rules and regulations developed by the 33 State Board of Education. Each of the 3 educational service 34 centers in a Class II county school unit outside a city of -4- LRB9011341THpk 1 500,000 or more population shall be disbanded on July 1, 2 1998, and their statutory responsibilities and programs shall 3 be assumed by the regional office of education serving that 4 portion of the Class II county school unit formerly served by 5 those disbanded educational service centers. The regional 6 superintendents of schools in each educational service region 7elected by the voters residing in all Class I countiesshall 8 serve as the chief administrators for alltheseprograms and 9 services provided in their respective educational service 10 regions pursuant to or as authorized under this Section and 11 Section 13A-10 of the School Code. Subject to the approval 12By ruleof the State Board of Education, anythe 1013 educational service region mayregions of lowest population14shallprovide such services under cooperative agreements with 15 otherlargerregions. 16 (Source: P.A. 88-89; 89-335, eff. 1-1-96.) 17 (105 ILCS 5/13A-10) 18 Sec. 13A-10. Alternative School Programs in Class II 19 Counties. Until July 1, 1998, the executive director of 20 educational service centers located in a Class II county 21 school unitcountiesoutside a city of 500,000 or more 22 inhabitants shall, for the educational service center area, 23 perform the duties assigned by this Article to regional 24 superintendents. Beginning July 1, 1998 and thereafter, those 25 duties shall again be the responsibility of and performed by 26 the regional superintendent of schools of the educational 27 service region serving that portion of the Class II county 28 school unit outside a city of 500,000 or more inhabitants. 29 (Source: P.A. 89-383, eff. 8-18-95; 89-629, eff. 8-9-96.) 30 Section 99. Effective date. This Act takes effect upon 31 becoming law.
