          Amends the Election Code.  Increases by $15  the  portion
      of  an election judge's daily compensation paid by the State.

 1        AN  ACT  to  amend the Election Code by changing Sections
 2    13-10, 13-11, and 17-30.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Election  Code  is amended by changing
 6    Sections 13-10, 13-11, and 17-30 as follows:
 7        (10 ILCS 5/13-10) (from Ch. 46, par. 13-10)
 8        Sec. 13-10.   The  compensation  of  the  judges  of  all
 9    primaries   and  all  elections,  except  judges  supervising
10    absentee ballots as provided in Section 19-12.2 of this  Act,
11    in  counties  of less than 600,000 inhabitants shall be fixed
12    by  the  respective  county  boards  or  boards  of  election
13    commissioners in all counties and municipalities, but  in  no
14    case  shall  such compensation be less than $35 nor more than
15    $90 $75 per day. The compensation of judges of all  primaries
16    and  all  elections  not under the jurisdiction of the county
17    clerk,  except  judges  supervising  absentee  balloting   as
18    provided in Section 19-12.2 of this Act, in counties having a
19    population  of  2,000,000  or more shall be not less than $60
20    nor more than $90 $75 per day. The compensation of judges  of
21    all primaries and all elections under the jurisdiction of the
22    county clerk, except judges supervising absentee balloting as
23    provided in Section 19-12.2 of this Act, in counties having a
24    population  of  2,000,000  or more shall be not less than $60
25    nor more than $90 $75 per day. The compensation of judges  of
26    all  primaries  and  all elections, except judges supervising
27    absentee ballots as provided in Section 19-12.2 of this  Act,
28    in  counties having a population of at least 600,000 but less
29    than 2,000,000 inhabitants shall be not  less  than  $45  nor
30    more  than  $90  $75  per day as fixed by the county board of
31    election commissioners of each such county.  In  addition  to

 1    their   per   day   compensation   and   notwithstanding  the
 2    limitations thereon stated herein, the judges of election, in
 3    all counties with a population of less than 600,000, shall be
 4    paid $3 each for each  100  voters  or  portion  thereof,  in
 5    excess  of  200  voters voting for candidates in the election
 6    district or precinct wherein the judge is serving, whether  a
 7    primary  or an election is being held. However, no such extra
 8    compensation shall be paid to the judges of election  in  any
 9    precinct in which no paper ballots are counted by such judges
10    of  election.  The  2 judges of election in counties having a
11    population of less than 600,000 who deliver  the  returns  to
12    the  county  clerk shall each be allowed and paid a sum to be
13    determined by the election authority for such services and an
14    additional sum per mile to  be  determined  by  the  election
15    authority  for  every  mile necessarily travelled in going to
16    and returning from the office or place to which they  deliver
17    the   returns.    The   compensation  for  mileage  shall  be
18    consistent with current rates paid for mileage  to  employees
19    of the county.
20        However, all judges who have been certified by the County
21    Clerk   or   Board   of   Election  Commissioners  as  having
22    satisfactorily completed, within the 2  years  preceding  the
23    day  of election, the training course for judges of election,
24    as provided in Sections 13-2.1, 13-2.2  and  14-4.1  of  this
25    Act,  shall  receive additional compensation of not less than
26    $10 nor more than $25  per  day  in  counties  of  less  than
27    600,000  inhabitants, the additional compensation of not less
28    than $10 nor more than  $25 per  day  in  counties  having  a
29    population  of  at  least  600,000  but  less  than 2,000,000
30    inhabitants  as  fixed  by  the  county  board  of   election
31    commissioners   of   each   such   county,   and   additional
32    compensation  of  not less than $20 nor more than $25 per day
33    in counties having a population  of  2,000,000  or  more  for
34    primaries  and  elections  not  under the jurisdiction of the

 1    county clerk, and additional compensation of  not  less  than
 2    $20 nor more than $25 per day in counties having a population
 3    of  2,000,000  or  more for primaries and elections under the
 4    jurisdiction of the county clerk.
 5        In  precincts  in  which  there  are  tally  judges,  the
 6    compensation of the tally judges shall be 2/3 of that of  the
 7    judges  of election and each holdover judge shall be paid the
 8    compensation of a judge of election  plus  that  of  a  tally
 9    judge.
10        Beginning on the effective date of this amendatory Act of
11    1998,  the  portion of an election judge's daily compensation
12    reimbursed by the State Board of Elections  is  increased  by
13    $15.

16        Sec.  13-11. It shall be the duty of the county clerk, on
17    the receipt of the election returns of any general or special
18    election,  to  make  out   his   certificate,   stating   the
19    compensation  to  which  the  judges  of each election may be
20    entitled for their services, and  lay  the  same  before  the
21    county  board  at its next session; and the board shall order
22    the compensation aforesaid to  be  paid  out  of  the  county
23    treasury.  The  State Board of Elections shall reimburse such
24    county in the amount of the increase in compensation provided
25    in Public Acts 81-850 and 81-1149 and by this amendatory  Act
26    of 1998.

29        Sec. 17-30.  Except as provided herein, each county shall
30    provide  for  and pay the costs and expenses of all elections
31    within the county other than within  the  jurisdiction  of  a
32    municipal  Board  of  Election  Commissioners, as well as the

 1    costs expended within the jurisdiction of a  municipal  Board
 2    of Election Commissioners for the registration and canvassing
 3    of  voters in even-numbered years. Each municipality with the
 4    first Board of Election Commissioners  established  within  a
 5    county  shall  provide  for and pay the costs and expenses of
 6    all  elections  within  the  jurisdiction  of  the  Board  of
 7    Election Commissioners. The State shall reimburse each county
 8    and  municipality  in  the  amount   of   the   increase   in
 9    compensation  provided  in Public Acts 81-850 and 81-1149 and
10    by this amendatory Act of 1998.
11        For each emergency referendum and each  special  election
12    not  conducted at the time of a regular election, each county
13    and municipality responsible for paying  for  the  costs  and
14    expenses  shall  directly  pay  for or be reimbursed by every
15    other political subdivision  for  which  officers  or  public
16    questions  are  on  the ballot within the jurisdiction of the
17    election authority of such county or municipality except such
18    costs and expenses as are required to be  reimbursed  by  the
19    State.  For  each  primary  election  for  the  nomination of
20    municipal officers held in a municipality with  a  population
21    of  5000  or less in accordance with Article 7, the county in
22    which such municipality is located shall be reimbursed by the
23    municipality for all costs and expenses attributable to  such
24    primary   election,  except  for  those  costs  and  expenses
25    required to be reimbursed by the State. Each  such  political
26    subdivision  shall  provide  for  and shall promptly pay such
27    reimbursement  of  the  total  costs  and  expenses  of  that
28    election attributable to its offices or propositions  as  the
29    case  may  be,  not  including such costs and expenses as are
30    required to be reimbursed by the State.
