90_SB1886 30 ILCS 500/1-15.15 30 ILCS 500/1-15.100 30 ILCS 500/1-30 Amends the Illinois Procurement Code. Applies the Code to procurements of the legislature and of executive branch constitutional officers, in addition to the Governor. Provides for the appointment by each of those entities of a chief procurement officer. Effective immediately. LRB9011449JMdv LRB9011449JMdv 1 AN ACT to amend the Illinois Procurement Code by changing 2 sections 1-15.15, 1-15.100, and 1-30. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Procurement Code is amended by 6 changing Sections 1-15.15, 1-15.100, and 1-30 as follows: 7 (30 ILCS 500/1-15.15) 8 Sec. 1-15.15. Chief Procurement Officer. "Chief 9 Procurement Officer" means: 10 (1) for procurements for construction and 11 construction-related services committed by law to the 12 jurisdiction or responsibility of the Capital Development 13 Board, the executive director of the Capital Development 14 Board. 15 (2) for procurements for all construction, 16 construction-related services, operation of any facility, and 17 the provision of any service or activity committed by law to 18 the jurisdiction or responsibility of the Illinois Department 19 of Transportation, including the direct or reimbursable 20 expenditure of all federal funds for which the Department of 21 Transportation is responsible or accountable for the use 22 thereof in accordance with federal law, regulation, or 23 procedure, the Secretary of Transportation. 24 (3) for all procurements made by a public institution of 25 higher education, a representative designated by the 26 Governor. 27 (4) for all other procurements or the executive branch 28 under the Governor, the Director of the Department of Central 29 Management Services. 30 (5) For procurements of the executive branch under a 31 constitutional officer other than the Governor, a person -2- LRB9011449JMdv 1 designated by that constitutional officer. 2 (6) For procurements of the legislative branch, a person 3 designated by the Joint Committee on Legislative Support 4 Services. 5 (Source: P.A. 90-572, eff. 2-6-98.) 6 (30 ILCS 500/1-15.100) 7 Sec. 1-15.100. State agency. "State agency" means and 8 includes all boards, commissions, agencies, institutions, 9 authorities, and bodies politic and corporate of the State, 10 created by or in accordance with the constitution or statute, 11 of the executive and legislative branchesbranchof State 12 government and does include colleges, universities, and 13 institutions under the jurisdiction of the governing boards 14 of the University of Illinois, Southern Illinois University, 15 Illinois State University, Eastern Illinois University, 16 Northern Illinois University, Western Illinois University, 17 Chicago State University, Governor State University, 18 Northeastern Illinois University, and the Board of Higher 19 Education. However, this term does not apply to public 20 employee retirement systems or investment boards that are 21 subject to fiduciary duties imposed by the Illinois Pension 22 Code or to the University of Illinois Foundation. "State 23 agency" does not include units of local government, school 24 districts, community colleges under the Public Community 25 College Act, and the Illinois Comprehensive Health Insurance 26 Board. 27 (Source: P.A. 90-572, eff. 2-6-98.) 28 (30 ILCS 500/1-30) 29 Sec. 1-30. Applicability to the Judicial Branch 30Constitutional Officers and the Legislative and Judicial31Branches. 32(a) The constitutional officers shall procure their-3- LRB9011449JMdv 1needs in a manner substantially in accordance with the2requirements of this Code and shall promulgate rules no less3restrictive than the requirements of this Code.4(b)Thelegislative andjudicial branch isbranches are5 exempt from this Code. Thelegislative andjudicial branch 6branchesshall make procurements in accordance with rules 7 promulgated to meet itstheirneeds. Procurement rules 8 promulgated by thelegislative andjudicial branchbranches9 may incorporate provisions of this Code. 10 (Source: P.A. 90-572, eff. date - See Sec. 99-5.) 11 Section 99.
