caption to a Section concerning emergency hospitalization.

1 AN ACT to amend the Health Maintenance Organization Act
2 by changing Section 5-7.1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Health Maintenance Organization Act is
6 amended by changing Section 5-7.1 as follows:
7 (215 ILCS 125/5-7.1) (from Ch. 111 1/2, par. 1415.1)
8 Sec. 5-7.1. Emergency hospitalization; denial of coverage
9 limited. No health care plan shall include any provision
10 which shall have the effect of denying coverage to or on
11 behalf of an enrollee under such plan on the basis of a
12 failure by the enrollee to file a notice of claim within the
13 time period required by the plan, provided such failure is
14 caused solely by the physical inability or mental incapacity
15 of the enrollee to file such notice of claim because of a
16 period of emergency hospitalization.
