New Act
Creates the Illinois Opportunity Scholarship Act to be
administered by the Illinois Student Assistance Commission
beginning with the 1999-2000 academic year. Provides for the
undergraduate scholarship awards for use at institutions of
higher education located in the State. The maximum annual
amount of a scholarship shall be equal to the tuition and
mandatory fees for a full-time undergraduate, in-state
student at the University of Illinois plus a $200 book
allowance. Provides that the annual amount of the
scholarship shall be based on a graduated rate of annual
family income up to a maximum family income of $75,000.

1 AN ACT to establish the Illinois Opportunity Scholarship
2 Program.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 1. Short title. This Act may be cited as the
6 Illinois Opportunity Scholarship Act.
7 Section 5. Creation of program. The Illinois
8 Opportunity Scholarship Program is hereby created under which
9 scholarships are to be awarded annually, beginning with the
10 1999-2000 academic year.
11 Section 10. Definitions. In this Act:
12 "Regular undergraduate program" means an academic program
13 of study in an institution of higher education at or below
14 the baccalaureate level leading to either a certificate,
15 nursing diploma, associate's degree, or bachelor's degree.
16 "Institution of higher education" means an institution of
17 higher learning as defined in Section 10 of the Higher
18 Education Student Assistance Act or an eligible institution
19 that is accredited by accrediting agencies which are
20 recognized by the United States Secretary of Education.
21 Section 15. Program administration. The Illinois
22 Opportunity Scholarship Program shall be administered by the
23 Illinois Student Assistance Commission, which shall publicize
24 the availability of scholarships under the program. All
25 applications for scholarships to be awarded under this Act
26 shall be made to the Illinois Student Assistance Commission
27 in a form prescribed by the Commission, and shall be
28 accompanied by such supporting documents as the Commission
29 requires to determine the scholarship eligibility of

1 applicants.
2 Section 20. Exclusivity. A recipient of an Illinois
3 Opportunity Scholarship may not hold any other scholarship
4 that is funded by any public funds of the State or awarded
5 under any other financial assistance program administered by
6 the Illinois Student Assistance Commission.
7 Section 25. Scholarship eligibility. Each recipient of
8 an Illinois Opportunity Scholarship shall:
9 (1) be accepted for admission in the regular
10 undergraduate program at an institution of higher education
11 or be enrolled in a 2-year associate degree program in the
12 State and in which the course work is acceptable for transfer
13 credit for an accredited baccalaureate program in an
14 institution of higher education;
15 (2) be a resident of the State;
16 (3) earn a cumulative grade point average after the
17 first semester of his or her senior year of at least 3.0 on a
18 4.0 scale, or its equivalent, in core curriculum courses as
19 calculated and indicated on the recipient's high school
20 transcript from a high school in this State;
21 (4) begin his or her education at an institution of
22 higher education within one year of completing high school
23 or, failing to do so, provide evidence satisfactory to the
24 Illinois Student Assistance Commission of extenuating
25 circumstances;
26 (5) be under the age of 22 years at the time of
27 receiving the first year of a scholarship award under this
28 Act;
29 (6) have successfully completed a college preparatory
30 program in high school;
31 (7) enroll in an institution of higher education as a
32 full-time student;

1 (8) have an annual total family income of $100,000 or
2 below;
3 (9) accept any other conditions attached to the award;
4 and
5 (10) satisfy any additional criteria the Illinois
6 Student Assistance Commission reasonably may establish.
7 Section 30. Scholarship amount. A scholarship provided
8 under the Illinois Opportunity Scholarship Program for
9 students with a total family income below $50,000 shall be
10 equal to the cost of tuition and mandatory fees for a
11 full-time undergraduate student at the Institution of higher
12 education at which the scholarship recipient enrolls, not to
13 exceed the equivalent expense for a full-time undergraduate,
14 in-state student at the University of Illinois at
15 Champaign-Urbana, plus $200 book allowance. For students
16 with a total family income between $50,000 and $59,999 the
17 scholarship provided shall be equal to 75% of the cost of
18 tuition and mandatory fees for a full-time undergraduate
19 student at the institution of higher education at which the
20 scholarship recipient enrolls, not to exceed the equivalent
21 expense for a full-time undergraduate, in-state student at
22 the University of Illinois at Champaign-Urbana, plus $200
23 book allowance. For students with a total family income
24 between $60,000 and $75,000, the scholarship amount shall be
25 equal to 50% of the cost of tuition and mandatory fees for a
26 full-time undergraduate student at the institution of higher
27 education at which the scholarship recipient enrolls, not to
28 exceed the equivalent expense for a full-time undergraduate,
29 in-state student at the University of Illinois at
30 Champaign-Urbana, plus $200 book allowance.
31 Section 35. Use of scholarships. An Illinois
32 Opportunity Scholarship may be used at any institution of

1 higher education or at a hospital diploma school in the State
2 for training registered nurses, if the curriculum is approved
3 by the Illinois Student Assistance Commission.
4 Section 40. Scholarship terms. Subject to the
5 provisions of Section 20, each recipient of an Illinois
6 Opportunity Scholarship may hold the award for 4 years if the
7 recipient:
8 (1) continues to be a resident of the State;
9 (2) continues to be a full-time student at an
10 institution of higher education and takes at least 12
11 semester hours of courses each semester or its equivalent as
12 determined by the Illinois Student Assistance Commission;
13 (3) upon completion of the recipient's freshman year,
14 has achieved a cumulative grade point average of at least 3.0
15 on a 4.0 scale and maintains this minimum cumulative grade
16 point average throughout the remainder of the award, or
17 failing to do so, provides evidence satisfactory to the
18 Illinois Student Assistance Commission of extenuating
19 circumstances;
20 (4) in the judgment of the institution of higher
21 education in which the recipient is enrolled, is making
22 satisfactory progress toward a degree; and
23 (5) maintains the standards of the institution of higher
24 education in which the recipient is enrolled.
25 Notwithstanding the forgoing provisions of this Section, a
26 recipient of an Illinois Opportunity Scholarship who is
27 enrolled in an associate degree program of an institution of
28 higher education may hold the award for 3 years if the
29 conditions set forth in paragraphs (1) through (5) of this
30 Section are met.
31 Section 45. Report of awards. On or before May 1 of
32 each year, the Illinois Student Assistance Commission shall

1 send each member of the General Assembly a list of the
2 individuals in each legislative district to whom Illinois
3 Opportunity Scholarships are awarded.
4 Section 50. Payment of scholarships. Subject to a
5 separate appropriation made for purposes of this Act,
6 scholarship awards shall be paid and distributed by the
7 Illinois Student Assistance Commission in accordance with
8 rules and regulations that the Commission shall promulgate to
9 administer the provisions of the Illinois Opportunity
10 Scholarship Program.
11 Section 99. Effective date. This Act takes effect
12 January 1, 1999.
