      30 ILCS 575/4             from Ch. 127, par. 132.604
          Amends the Business Enterprise for  Minorities,  Females,
      and  Persons  with  Disabilities Act.  Provides that not less
      than 19% (now 12%)  of  the  total  dollar  amount  of  State
      contracts  shall  be  established  as a goal to be awarded to
      minorities, females, and persons with disabilities.  Provides
      that, of those contracts, as nearly as possible, 26% shall be
      awarded to minority  male  owned  businesses,  42%  shall  be
      awarded to non-minority female owned businesses, 21% shall be
      awarded to minority female owned businesses, and 11% shall be
      awarded  to  businesses  owned  by  persons with disabilities
      (now, of those contracts, five-twelfths shall be  awarded  to
      female  owned  businesses  and  one-sixth shall be awarded to
      businesses owned by persons with disabilities).

 1        AN ACT to amend the Business Enterprise  for  Minorities,
 2    Females,  and  Persons  with  Disabilities  Act  by  changing
 3    Section 4.
 4        Be  it  enacted  by  the People of the State of Illinois,
 5    represented in the General Assembly:
 6        Section  5.   The  Business  Enterprise  for  Minorities,
 7    Females, and Persons with  Disabilities  Act  is  amended  by
 8    changing Section 4 as follows:

10        (Section scheduled to be repealed on September 6, 1999)
11        Sec. 4. Award of State contracts.
12        (a)  Except  as provided in subsection (b), not less than
13    19% 12% of the total dollar amount  of  State  contracts,  as
14    defined  by  the Secretary of the Council and approved by the
15    Council, shall be established as a  goal  to  be  awarded  to
16    businesses  owned  by  minorities,  females, and persons with
17    disabilities; provided, however, that as nearly  as  possible
18    (i)  contracts  representing  26%  of the total amount of all
19    State contracts awarded to businesses  owned  by  minorities,
20    females,  and  persons  with  disabilities under this Section
21    shall be awarded to  minority  male  owned  businesses,  (ii)
22    contracts  representing  42% of the total amount of all State
23    contracts awarded to businesses owned by minorities, females,
24    and persons with disabilities under  this  Section  shall  be
25    awarded  to  non-minority female owned businesses, (iii) that
26    contracts representing 21%  at  least  five-twelfths  of  the
27    total  amount  of  all  State contracts awarded to businesses
28    owned by minorities, females, and persons  with  disabilities
29    pursuant  to this Section shall be awarded to minority female
30    owned businesses, and (iv) that contracts representing 11% at
31    least one-sixth of the total amount of  all  State  contracts

 1    awarded  to  businesses  owned  by  minorities,  females, and
 2    persons with disabilities pursuant to this Section  shall  be
 3    awarded to businesses owned by persons with disabilities.
 4        The  above  percentage relates to the total dollar amount
 5    of State contracts during each State fiscal year,  calculated
 6    by  examining  independently  each  type of contract for each
 7    agency or university which lets such  contracts.   Only  that
 8    percentage of arrangements which represents the participation
 9    of  businesses owned by minorities, females, and persons with
10    disabilities on such contracts shall be included.
11        (b)  In the case of  State  construction  contracts,  the
12    provisions  of  subsection  (a)  requiring a portion of State
13    contracts to be awarded to businesses owned and controlled by
14    persons with disabilities do not apply.  Not less than 10% of
15    the total dollar amount of State  construction  contracts  is
16    established  as  a  goal to be awarded to minority and female
17    owned businesses,  and  contracts  representing  50%  of  the
18    amount   of  all  State  construction  contracts  awarded  to
19    minority and female owned  businesses  shall  be  awarded  to
20    female owned businesses.
