90_SC0051 ILCON Art. X, Sec. 2 Proposes to amend Section 2 of Article X of the Illinois Constitution. Provides that the State Superintendent of Education shall be elected at the general election to serve a term of 4 years beginning on the second Monday of January following his or her election. Establishes eligibility criteria for the office and provides for the manner of filling a vacancy in the office. Includes a Schedule under which the term of office of the appointed State Superintendent of Education expires when the first elected State Superintendent of Education takes office. LRB9010443THpk LRB9010443THpk 1 SENATE JOINT RESOLUTION 2 CONSTITUTIONAL AMENDMENT 3 RESOLVED, BY THE SENATE OF THE NINETIETH GENERAL ASSEMBLY 4 OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES 5 CONCURRING HEREIN, That there shall be submitted to the 6 electors of the State for adoption or rejection at the 7 general election next occurring at least 6 months after the 8 adoption of this resolution a proposition to amend Section 2 9 of Article X of the Constitution as follows: 10 ARTICLE X 11 EDUCATION 12 (ILCON Art. X, Sec. 2) 13 SECTION 2. STATE BOARD OF EDUCATION - STATE SUPERINTENDENT OF 14 EDUCATIONCHIEF STATE EDUCATIONAL OFFICER15 (a) There is created a State Board of Education to be 16 elected or selected on a regional basis. The number of 17 members, their qualifications, terms of office and manner of 18 election or selection shall be provided by law. The Board, 19 except as limited by law, may establish goals, determine 20 policies, provide for planning and evaluating education 21 programs and recommend financing. The Board shall have such 22 other duties and powers as provided by law. 23 (b) A State Superintendent of Education shall be elected 24 by the electors of the State at the general election every 4 25 years, beginning in 2000. The State Superintendent of 26 Education shall hold office for 4 years beginning on the 27 second Monday of January after his or her election. To be 28 eligible to hold the office of State Superintendent of 29 Education a person must be a United States citizen, at least 30 25 years old, and a resident of the State for 10 years 31 preceding his or her election. 32 Any vacancy in the office of State Superintendent of 33 Education shall be filled in the manner provided in Section 7 -2- LRB9010443THpk 1 of Article V. 2 The State Superintendent shall be the chief educational 3 officer of the State for elementary and secondary education 4 and shall have the duties and powers that may be prescribed 5 by law.The State Board of Education shall appoint a chief6state educational officer.7 (Source: Illinois Constitution.) 8 SCHEDULE 9 This Constitutional Amendment takes effect upon approval 10 by the electors of this State, and when the State 11 Superintendent of Education initially elected under Section 2 12 of Article X of the Illinois Constitution takes office, the 13 term of office of the chief state educational officer 14 appointed by the State Board of Education shall expire.
