90_SR0090 LRB9005862DPcw 1 SENATE RESOLUTION 2 WHEREAS, On May 28, 1997, House Bill 297 passed both 3 houses of the General Assembly; and 4 WHEREAS, House Bill 297 amends the Dram Shop provisions 5 of the Liquor Control Act of 1934, which provide a person 6 injured by an intoxicated person with a right of recovery 7 against a person who is licensed to sell liquor and who 8 caused the intoxication; and 9 WHEREAS, House Bill 297 sets maximum limits on an injured 10 person's recovery and adds loss of society in the event of 11 death or personal injury as a basis for recovery under the 12 Act; and 13 WHEREAS, Ninety percent of incidents concerning tavern 14 owner liability for injuries related to the consumption of 15 alcohol are covered under liquor liability insurance 16 policies; and 17 WHEREAS, Twenty-five percent of claims filed pursuant to 18 the Dram Shop provisions involve physical altercations; 19 therefore, be it 20 RESOLVED, BY THE SENATE OF THE NINETIETH GENERAL 21 ASSEMBLY OF THE STATE OF ILLINOIS, that we urge the Director 22 of the Department of Insurance not to issue an opinion that 23 insurance companies in Illinois are not required to include 24 coverage for assault and battery related injuries under 25 liquor liability policies; and be it further 26 RESOLVED, that a suitable copy of this resolution be 27 forwarded to the Director of the Department of Insurance.
