   DART-GASH-SCOTT-MCCARTHY-SCULLY.

   235 ILCS 5/6-1            from Ch. 43, par. 119

   235 ILCS 5/7-1            from Ch. 43, par. 145                             

        Amends the Liquor Control  Act.  Increases  the  maximum  amounts      
   recoverable  in  a dram shop action to $50,000 for damages and $60,000      
   for loss of support. Provides that the Liquor Control Commission shall      
   not renew a retailer's license without proof of insurance.                  
        HOUSE AMENDMENT NO. 1.                                                 
        Deletes everything.  Amends the Liquor Control Act. Increases the      
   maximum amounts recoverable in a dram  shop  action  to  $100,000  for      
   damages  and  $150,000  for loss of support. Provides that damages for      
   loss of society are recoverable in the same  manner  as  for  loss  of      
   support.   Provides that the Liquor Control Commission shall not renew      
   a retailer's license without proof of insurance. Provides for recovery      
   in a dram shop action against a person who is  not  licensed  to  sell      
   alcoholic liquor.                                                           
          STATE MANDATES ACT FISCAL NOTE                                       
          Fails to meet the definition of a State mandate.                     
          FISCAL NOTE (Liquor Control Commission)                              
          HB87 will have a fiscal impact of approximately $5,000.              
          FISCAL NOTE, AMENDED (Liquor Control Commission)                     
          Fiscal impact would be limited to the tripling of coverage in        
          dram shop insurance premium rates, with no fiscal impact on          
          the Liquor Control Commission.
