SMITH,MICHAEL-STEPHENS-HOLBROOK-BRADFORD-BOLAND.

(SHADID-CARROLL-RADOGNO)

   720 ILCS 5/12-4           from Ch. 38, par. 12-4                            

        Amends the Criminal Code of 1961.  Provides that a person commits      
   aggravated  battery  if  he  or  she  knowingly  and   without   legal      
   justification  and  by  any means causes bodily harm to a merchant who      
   detains the person for alleged commission of retail theft.                  
          FISCAL NOTE (Dept. of Corrections)                                   
          There will be a minimal fiscal impact on this Dept.                  
          CORRECTIONAL NOTE                                                    
          No change from previous note.                                        
          JUDICIAL NOTE                                                        
          It is not possible to determine what impact the bill will have       
          on the need to increase the number of judges in the state.
