   65 ILCS 5/11-138-1        from Ch. 24, par. 11-138-1

   605 ILCS 5/9-113.2 new                                                      

        Amends the Illinois Municipal Code to authorize a municipality or      
   water company (now a water company) to locate or change the source  of      
   a  water  supply to a point not more than 60 (now 20) miles beyond the      
   municipality's corporate limits.   Provides  that  a  municipality  or      
   water  company  changing  or  locating its water supply may construct,      
   repair, or remove underground water pipes within any highway  easement      
   with  the  permission  of the highway authority or commissioner of the      
   township  or  road  district.   Amends  the  Illinois  Highway   Code.      
   Provides  that State highway authorities and highway commissioners may      
   regulate the use  of  roads  and  their  easements  for  constructing,      
   repairing,  and  removing  underground gas, water, and sewer pipes and      
   underground utilities.

        Deletes  everything.   Amends  the   Illinois   Municipal   Code.      
   Authorizes  a  municipality  or  other entity (now a water company) to      
   locate or change the source of a public water supply as defined in the      
   Environmental Protection Act.    Amends  the  Illinois  Highway  Code.      
   Provides  that consent granted by the appropriate highway authority to      
   a municipality  or  other  entity  for  the  location,  placement,  or      
   construction of a public water supply under and alongside a highway or      
   road  shall  relieve  that  municipality  or entity from obtaining the      
   approval of the owner of the fee over or under which  the  highway  or      
   road is located for as long as the highway or road used for highway or      
   road purposes.
