   FANTIN, HOWARD, FLOWERS, YOUNGE AND MCKEON.

   305 ILCS 5/4-2            from Ch. 23, par. 4-2                             

        Amends the Temporary Assistance for Needy Families (TANF) Article      
   of  the  Illinois  Public  Aid  Code.   Provides  that  the  provision      
   prohibiting the increase of the amount of an assistance grant for  the      
   birth  of  an additional child shall not exclude the inclusion of that      
   additional child when determining eligibility for and  the  amount  of      
   assistance  for  an  assistance  unit  during  any  month in which the      
   assistance unit has earned income.  Provides that the Department shall      
   pass through to the custodial parent  of  a  child  excluded  from  an      
   assistance  unit under these provisions all child support collected on      
   that child's behalf and shall treat the child support as exempt income      
   in determining the cash assistance grant of the assistance unit.

        Deletes  everything.   Amends  the  Illinois  Public  Aid   Code.      
   Provides  that  the Department of Human Services and the Department of      
   Public Aid shall implement at least 2 3-year pilot  projects  to  test      
   the  effects  of passing certain amounts of child support collected by      
   the Department of  Public  Aid  through  to  families  receiving  cash      
   assistance  under  Article IV.  Provides that the child support passed      
   through to a family shall not affect the family's eligibility  for  or      
   the  amount  of  assistance  provided  under Article IV within certain      
   limits.  Provides that no later than 6 months after the conclusion  of      
   the  pilot  projects,  the Departments shall report their findings and      
   recommendations for change, if any, to the General Assembly.  Requires      
   the Department of Public Aid to pass  through  to  families  receiving      
   cash  assistance  under  Article  IV  the  first  $50 of child support      
   collected  by  the  Department   without   affecting   the   families'      
   eligibility for or the amount of assistance under Article IV.  Deletes      
   provisions  allowing  money  to  be transferred from the Child Support      
   Enforcement Trust Fund to the General Revenue Fund each year.

          This legislation would cost $3.4 M to $4.9 M per year; provi-        
          sions requiring $50 pass through per order would cost $2.9 M         
          while pilot projects would cost $500,000 to $2 M per year.           
        HOUSE AMENDMENT NO. 2.                                                 
        Provides that the pilot projects may be limited to  one  or  more      
   sites  within  the  counties  chosen  and  do not need to be conducted      
   county-wide.  Provides that the provision requiring the first  $50  of      
   child  support collected to be passed through to recipients applies to      
   those families not covered by a pilot project under these  provisions.      
   Provides that both the pilot projects and the general $50 pass through      
   program  are  conditioned upon the General Assembly's appropriation of      
   sufficient funds from the General Revenue Fund to reimburse the  Child      
   Support Enforcement Trust Fund for the expenses.
