Short description:
HUMAN SERVICES DELIVERY ACT

Synopsis of Bill as introduced:
Creates the Human Services Delivery Act. Provides that no
grantee or contractor shall receive a grant or enter into a contract
for providing residential services for the mentally ill or
developmentally disabled without certifying to the State or other
granting or contracting agency that it either has not been in
violation of the National Labor Relations Act within the last year, or
if it has, that the violations have been fully cured, subject to
suspension or termination of the grant or contract if it is determined
that the grantee or contractor falsely completed the certification or,
subsequent to the effective date of the grant or contract, violates
the National Labor Relations Act, which shall in turn subject the
grantee or contractor to debarment from seeking grants or contracts
covered under this Act for 3 years. All proceedings for suspension,
termination, or debarment are subject to the Administrative Procedure
   Act. Effective immediately.
          FISCAL NOTE (DCMS)
HB 735 has no fiscal impact on DCMS.
          STATE MANDATES FISCAL NOTE
In the opinion of DCCA, HB735 fails to meet the definition of a
          State mandate.
        HOUSE AMENDMENT NO. 1.
Deletes everything and reinserts language similar to the bill as
introduced but makes the following changes: makes the Act apply to day
treatment service providers also; replaces language in the bill
regarding grant and contract restrictions with language that grant and
contract restrictions apply if the grantee or contractor has been
found to have committed 3 or more unfair labor practices during the 24
month period preceding the effective or renewal date of the contract
or grant; provides for remediation sessions to be held by the
Department of Human Services between the contractor or grantee and a
labor organization when a labor organization files a complaint against
the contractor or grantee; and provides that the Department may make a
finding that the violation is only de minimus. Makes other changes.
   Effective immediately.
          FISCAL NOTE, H-AM 1 (DMHDD)
This bill adds additional administrative oversight reponsibili-
ties; however, the volume of activity that may result is un-
          known.
