Senate Sponsors: LUECHTEFELD Short description: BARBER-COSMET-EXCEPTIONS Synopsis of Bill as introduced: Amends the Barber, Cosmetology, Esthetics, and Nail Technology Act of 1985 to exclude from regulation under the Act certain providers of personal care and health care services. Effective immediately. SENATE AMENDMENT NO. 1. Adds reference to: 225 ILCS 410/3-7 from Ch. 111, par. 1703-7 Amends the Barber, Cosmetology, Esthetics, and Nail Technology Act of 1985 in provisions concerning cosmetologists, cosmetology teachers, and cosmetology clinic teachers. Requires the Department of Professional Regulation to inform a licensee about any changes in the law or rules. Provides that the continuing education requirements for cosmetologists do not apply to a licensee who is at least 55 (instead of 62) years of age or has been licensed for at least 25 (instead of 30) years and removes the requirement that this licensee not work regularly. These provisions effective July 1, 1998. SENATE AMENDMENT NO. 2. Deletes reference to: 225 ILCS 410/1-11 Adds reference to: 225 ILCS 410/3C-4 from Ch. 111, par. 1703C-4 225 ILCS 410/4-5.1 Deletes everything. Amends the Barber, Cosmetology, Esthetics, and Nail Technology Act of 1985. In provisions concerning cosmetologists, provides that the exemption from the continuing education requirements for a licensee who is at least 62 years of age applies only to a licensee who is at least 62 years of age before January 1, 1999. Provides that continuing education requirements do not apply to a licensee who has been licensed for at least 25 (instead of 30) years and does not work for more than 14 (instead of 16) hours per week. Provides that the funds deposited under the Act into the General Professions Dedicated Fund may be used by the Department of Professional Regulation to publish and distribute a newsletter to all persons licensed under the Act that contains information about any changes in the Act or rules. Provides that the Department may also distribute copies of the Act and rules during the renewal process if appropriate funding is available. Effective January 1, 1999.
