House Sponsors: BURKE. Short description: SCH CD-ANNEX TERR-PROCEDURE Synopsis of Bill as introduced: Amends the School Code. In provisions concerning the annexation of non-coterminous territory from an elementary or high school district, adds the requirement that the petitioners and school district follow certain procedures after filing the petition with the regional board of school trustees and regional superintendent having supervision over the greatest portion of the territory. Removes the prohibition on the State Board of Education having authority or discretion to hear any evidence or consider any issues except those that may be necessary to determine whether the limitations and conditions of the provisions concerning the annexation of non-coterminous territory from an elementary or high school district have been met. Provides that the changes made by this amendatory Act apply to all cases pending before the State Board of Education or a court. Effective immediately. FISCAL NOTE (State Board of Education) There may be additional time spent by hearing officers; no fiscal impact on local school districts. STATE MANDATES FISCAL NOTE (State Board of Education) No change from SBE fiscal note. HOUSE AMENDMENT NO. 1. Provides that the changes made by this amendatory Act apply only to petitions filed with the State Board of Education on or after January 1, 1998 (instead of applying to all cases pending before the State Board of Education or a court on or after the effective date of this amendatory Act).
