House Sponsors: LOPEZ-ERWIN-ACEVEDO Short description: CRIM CD-ENDANGERING CHILD Synopsis of Bill as introduced: Amends the Criminal Code of 1961, relating to the offense of endangering the life or health of a child. Provides that endangering the life of a child is a Class 3 felony for a first offense and a Class 2 felony for a second or subsequent offense. If death of the child results, it is a Class X felony. Provides that endangering the health of a child is a Class A misdemeanor for a first offense and a Class 3 felony for a second or subsequent offense (now the current law for endangering either the life or health of the child). SENATE AMENDMENT NO. 1. Eliminates provisions that limit criminal liability for endangering the life or health of the child to those persons having the care or custody of the child under 18. CORRECTIONAL NOTE SB340 would increase the prison population by 31 inmates at a cost of $5,779,700 over ten years.
