91_HB0137enr HB0137 Enrolled LRB9100793LDmb 1 AN ACT to amend the Liquor Control Act of 1934 by adding 2 Section 6-9.1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Liquor Control Act of 1934 is amended by 6 adding Section 6-9.1 as follows: 7 (235 ILCS 5/6-9.1 new) 8 Sec. 6-9.1. Deliveries to retail establishments. 9 (a) A distributor of wine or spirits shall deliver to 10 any retailer within any geographic area in which that 11 distributor has been granted by a wholesaler the right to 12 sell its trademark, brand, or name at least once every 2 13 weeks if (i) in the case of a retailer located in a county 14 with a population of at least 3,000,000 inhabitants or in a 15 county adjacent to a county with at least 3,000,000 16 inhabitants, the retailer agrees to purchase at least $200 of 17 wine or spirits from the distributor every 2 weeks; or (ii) 18 in the case of a retailer located in a county with a 19 population of less than 3,000,000 that is not adjacent to a 20 county with a population of at least 3,000,000 inhabitants, 21 the retailer agrees to purchase at least $50 of wine or 22 spirits from the distributor every 2 weeks. 23 (b) On January 1, 2002 and every 2 years thereafter, the 24 dollar amounts in items (i) and (ii) of subsection (a) shall 25 be increased or decreased by a percentage equal to the 26 percentage increase or decrease in the Consumer Price Index 27 during the previous 2 years according to the most recent 28 available data.
