 1        AN  ACT  to  amend  the Illinois Vehicle code by changing
 2    Sections 3-405.1 and 3-806.1.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.  The  Illinois  Vehicle  Code  is  amended by
 6    changing Sections 3-405.1 and 3-806.1 as follows:

 7        (625 ILCS 5/3-405.1) (from Ch. 95 1/2, par. 3-405.1)
 8        Sec. 3-405.1.  Application for  vanity  and  personalized
 9    license plates.
10        (a)  Vanity  license  plates  mean  any  license  plates,
11    assigned  to a passenger motor vehicle of the first division,
12    to a motor vehicle of the second division registered  at  not
13    more than 8,000 pounds, or to a recreational vehicle, or to a
14    commercial  vehicle  of  the first division that is part of a
15    livery  service,  which   display   a   registration   number
16    containing  4  to  7 letters as requested by the owner of the
17    vehicle and license  plates  issued  to  retired  members  of
18    Congress  under  Section 3-610.1 or to retired members of the
19    General Assembly as provided in Section  3-606.1.  A  license
20    plate  consisting of 3 letters and no numbers or of 1, 2 or 3
21    numbers, upon its becoming available,  is  a  vanity  license
22    plate.  Personalized  license plates mean any license plates,
23    assigned to a passenger motor vehicle of the first  division,
24    to   a  motor  vehicle  of  the  second  division,  or  to  a
25    recreational vehicle, or to a commercial vehicle of the first
26    division that is part of a livery service,  which  display  a
27    registration  number  containing a combination of letters and
28    numbers as prescribed by rule, as requested by the  owner  of
29    the vehicle.
30        (b)  For  any  registration period commencing after 1979,
31    any person who is the registered owner of a  passenger  motor

 1    vehicle  of  the  first  division,  of a motor vehicle of the
 2    second division registered at not more than 8,000 pounds,  or
 3    of  a recreational vehicle, or to a commercial vehicle of the
 4    first division that is part of a livery  service,  registered
 5    with  the  Secretary of State or who makes application for an
 6    original registration of such  a  motor  vehicle  or  renewal
 7    registration  of  such a motor vehicle may, upon payment of a
 8    fee prescribed in Section 3-806.1, apply to the Secretary  of
 9    State for personalized license plates.
10        (c)  Except  for  plates  issued  under  Sections  3-627,
11    3-631,  and  3-632, vanity and personalized license plates as
12    issued under this Section shall be the same color and  design
13    as  other  passenger  vehicle license plates and shall not in
14    any  manner  conflict  with  any  other  existing  passenger,
15    commercial, trailer, motorcycle,  or  special  license  plate
16    series.   However,  special  registration plates issued under
17    Sections 3-611 and 3-616 for  vehicles  operated  by  or  for
18    persons  with disabilities may also be vanity or personalized
19    license plates.
20        (d)  Vanity and  personalized  license  plates  shall  be
21    issued  only  to the registered owner of the vehicle on which
22    they are to be displayed,  except  as  provided  in  Sections
23    3-611  and 3-616 for special registration plates for vehicles
24    operated by or for persons with disabilities.
25        (e)  An  applicant  for  the  issuance   of   vanity   or
26    personalized  license  plates  or  subsequent renewal thereof
27    shall file an application in such form and manner and by such
28    date as the  Secretary  of  State  may,  in  his  discretion,
29    require.
30        No  vanity  nor  personalized  license  plates  shall  be
31    approved,  manufactured,  or  distributed  that  contain  any
32    characters,    symbols    other    than   the   international
33    accessibility symbol for vehicles operated by or for  persons
34    with disabilities, foreign words, or letters of punctuation.

 1        (f)  Vanity  and  personalized  license  plates as issued
 2    pursuant  to  this  Act  may  be  subject  to  the  Staggered
 3    Registration System as prescribed by the Secretary of State.
 4        (g)  For purposes of this Section, "livery service" means
 5    any commercial entity that:
 6             (1)  owns 10 or fewer first division motor vehicles;
 7             (2)  uses its first division motor vehicles for  the
 8        transportation  of  persons  for-hire when the payment is
 9        not based on a meter charge, but  is  prearranged  for  a
10        designated destination; and
11             (3)  is  not  located  within  a municipality with a
12        population greater than 2,000,000.

16        Sec. 3-806.1.  Additional fees for vanity license plates.
17    In  addition  to  the  regular registration fee, an applicant
18    shall be charged $75 for each set of  vanity  license  plates
19    issued  to  a  motor  vehicle  of the first division, to or a
20    motor vehicle of the second division registered at  not  more
21    than  8,000  pounds,  or  to  a recreational vehicle, or to a
22    commercial vehicle of the first division that is  part  of  a
23    livery  service,  as  defined in Section 3-405.1, and $40 for
24    each set  of  vanity  plates  issued  to  a  motorcycle.   In
25    addition  to  the  regular renewal fee, an applicant shall be
26    charged $10 for the renewal of each  set  of  vanity  license
27    plates.
