 1        AN  ACT  to  amend  the  Criminal  Code of 1961 by adding
 2    Section 12-10.1.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section   5.   The  Criminal  Code  of 1961 is amended by
 6    adding Section 12-10.1 as follows:

 7        (720 ILCS 5/12-10.1 new)
 8        Sec. 12-10.1.  Piercing the body of a minor.
 9        (a)(1)  Any person who pierces or offers  to  pierce  the
10    body  of  a  person  under  18  years  of age without written
11    consent of a parent or legal guardian of that person  commits
12    the offense of piercing the body of a minor.
13        (2)  Sentence.  Piercing the body of a minor is a Class C
14    misdemeanor.
15        (b)  A person under 18 years of age who misrepresents his
16    or  her  age  as  18  years  of  age  or over to receive body
17    piercing is guilty of a Class C misdemeanor.
18        (c)  Definition.  As used in this  Section,  to  "pierce"
19    means  to make a hole in the body in order to insert or allow
20    the insertion of any ring, hoop, stud, or  other  object  for
21    the purpose of ornamentation of the body.
22        (d)  Exceptions.   This  Section  may not be construed in
23    any way to prohibit any injection, incision, acupuncture,  or
24    similar  medical  or dental procedure performed by a licensed
25    health  care  professional  or  other  person  authorized  to
26    perform that procedure. This Section does  not  prohibit  ear
27    piercing.  This Section does not apply to a minor emancipated
28    under the Juvenile Court Act of 1987 or the  Emancipation  of
29    Mature Minors Act or by marriage.

30        Section  99.  Effective  date.   This Act takes effect 30
