91_HB0632eng HB0632 Engrossed LRB9101751SMdvA 1 AN ACT to amend the Illinois Propane Education and 2 Research Act of 1997 by changing Section 5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Propane Education and Research 6 Act of 1997 is amended by changing Section 5 as follows: 7 (430 ILCS 27/5) 8 Sec. 5. Definitions. In this Act, unless the context 9 otherwise requires: 10 "Council" means a Propane Education and Research Council 11 created pursuant to Section 10 of this Act; 12 "Director" means Director of Agriculture or his or her 13 designee; 14 "Education" means any action to provide information 15 regarding propane, propane equipment, mechanical and 16 technical practices, and propane uses to consumers and 17 members of the propane industry; 18 "Industry" means those persons involved in the 19 production, transportation, and sale of propane, and the 20 manufacture and distribution of propane utilization 21 equipment; 22 "Industry trade association" means an organization exempt 23 from tax, under Section 501(c)(3), or (6) of the Internal 24 Revenue Code of 1986, representing the propane industry; 25 "Odorized propane" means propane which has an odorant 26 added to it; 27 "Placed into commerce" means delivered, transported for 28 storage, or sold within the State of Illinois; 29 "Producer" means the owner of propane at the time it is 30 recovered at a gas processing plant or refinery; irrespective 31 of the state where production occurs; HB0632 Engrossed -2- LRB9101751SMdvA 1 "Propane" means a hydrocarbon whose chemical composition 2 is predominately C3H8, whether recovered from natural gas or 3 crude oil, and includes liquified petroleum gases and 4 mixtures thereof; 5 "Public member" means a member of the Council other than 6 a representative of producers or retail marketers 7 representing significant users of propane, public safety 8 officials, state regulatory officials, or other groups 9 knowledgeable about propane; 10 "Qualified industry organization" means the Illinois 11 Propane Gas Association, the National Propane Gas 12 Association, the Gas Processors Association, a successor 13 association of these associations, or any other propane 14 industry organization; 15 "Research" means any type of study, investigation or 16 other activities designed to advance the image, desirability, 17 usage, marketability, efficiency, and safety of propane and 18 to further the development of such information; 19 "Retail marketer" means a person engaged primarily in the 20 sale of odorized propane to the ultimate consumer or to 21 retail propane dispensers; and 22 "Retail propane dispenser" means a person who sells 23 odorized propane to the ultimate consumer but is not engaged 24 primarily in the business of such sales. 25 (Source: P.A. 90-305, eff. 1-1-98.)
