91_HB0706eng HB0706 Engrossed LRB9103453KSmg 1 AN ACT to amend the Home Repair Fraud Act by changing 2 Section 4. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Home Repair Fraud Act is amended by 6 changing Section 4 as follows: 7 (815 ILCS 515/4) (from Ch. 121 1/2, par. 1604) 8 Sec. 4. Penalties. 9 (a) Violation of paragraphs (1) or (2) of subsection (a) 10 of Section 3 of this Act shall be a Class 4 felony when the 11 amount of the contract or agreement is more than $1,000, a 12 Class A misdemeanor when the amount of the contract or 13 agreement is $1,000 or less, and a Class 4 felony for the 14 second or subsequent offense when the amount of the contract 15 or agreement is $1,000 or less. If 2 or more contracts or 16 agreements for home repair exceed an aggregate amount of 17 $1,000 or more and such contracts or agreements are entered 18 into with the same victim by one or more of the defendants as 19 part of or in furtherance of a common fraudulent scheme, 20 design or intention, the violation shall be a Class 4 felony. 21 (b) Violation of paragraph (3) of subsection (a) of 22 Section 3 of this Act shall be a Class 3 felony when the 23 amount of the contract or agreement is more than $10,000 and 24 a Class 4 felony when the amount of the contract or agreement 25 is $10,000 or less. 26 (c) Violation of paragraph (4) of subsection (a) of 27 Section 3 of this Act shall be a Class 4 felony when the 28 amount of the contract or agreement is more than $1,000, a 29 Class A misdemeanor when the amount of the contract or 30 agreement is $1,000 or less, and a Class 4 felony for a 31 second or subsequent offense when the amount of the contract HB0706 Engrossed -2- LRB9103453KSmg 1 or agreement is $1,000 or less. If 2 or more contracts or 2 agreements for home repair exceed an aggregate amount of 3 $1,000 or more and such contracts or agreements are entered 4 into with the same victim by one or more of the defendants as 5 part of or in furtherance of a common fraudulent scheme, 6 design or intention, the violation shall be a Class 4 felony. 7 (d) Violation of paragraphs (1) or (2) of subsection (b) 8 of Section 3 of this Act shall be a Class 4 felony. 9 (Source: P.A. 84-1270.)
