 1                     AMENDMENT TO HOUSE BILL 729

 2        AMENDMENT NO.     .  Amend House Bill 729,  by  replacing
 3    the title with the following:
 4        "AN  ACT  to  amend the Criminal Code of 1961 by changing
 5    Section 11-9.1."; and

 6    by replacing everything after the enacting  clause  with  the
 7    following:

 8        "Section  5.   The  Criminal  Code  of 1961 is amended by
 9    changing Section 11-9.1 as follows:

10        (720 ILCS 5/11-9.1) (from Ch. 38, par. 11-9.1)
11        Sec. 11-9.1. Sexual exploitation of a child.
12        (a)  Any person commits sexual exploitation of a child if
13    in the presence of a child and with intent or knowledge  that
14    a child would view his or her acts, that person:
15             (1)  engages in a sexual act; or
16             (2)  exposes  his  or her sex organs, anus or breast
17        for the purpose of sexual  arousal  or  gratification  of
18        such person or the child.
19        (a-5)  A  person  commits  sexual exploitation of a child
20    who knowingly entices,  coerces,  or  persuades  a  child  to
21    remove the child's clothing for the purpose of sexual arousal

 1    or gratification of the person or the child, or both.
 2        (b)  Definitions.  As used in this Section:
 3        "Sexual act" means masturbation, sexual conduct or sexual
 4    penetration as defined in Section 12-12 of this Code.
 5        "Sex  offense"  means any violation of Article 11 of this
 6    Code or a violation of Section 12-13, 12-14, 12-14.1,  12-15,
 7    12-16, or 12-16.2 of this Code.
 8        "Child" means a person under 17 years of age.
 9        (c)  Sentence.
10             (1)  Sexual  exploitation  of  a  child is a Class A
11        misdemeanor.  A second or subsequent  violation  of  this
12        Section is a Class 4 felony.
13             (2)  Sexual  exploitation  of  a  child is a Class 4
14        felony if the person has been previously convicted  of  a
15        sex offense.
