91_HB0766 LRB9103296ACtm 1 AN ACT to amend the Environmental Protection Act by 2 changing Section 32. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Environmental Protection Act is amended 6 by changing Section 32 as follows: 7 (415 ILCS 5/32) (from Ch. 111 1/2, par. 1032) 8 Sec. 32. Hearings. All hearings under this Title shall be 9 held before a qualified hearing officer, who may be attended 10 by at least one member of the Board, designated by the 11 Chairman. All such hearings shall be open to the public, and 12 any person may submit written statements to the Board in 13 connection with the subject thereof. In addition, the Board 14 may permit any person to offer oral testimony. 15 Any party to a hearing under this subsection may be 16 represented by counsel, may make oral or written argument, 17 offer testimony, cross-examine witnesses, or take any 18 combination of such actions. All testimony taken before the 19 Board shall be recorded stenographically. The transcript so 20 recorded, and any additional matter accepted for the record, 21 shall be open to public inspection, and copies thereof shall 22 be made available to any person upon payment of the actual 23 cost of reproducing the original. 24 (Source: P.A. 76-2429.)
