91_HB0964 LRB9102774DJcd 1 AN ACT to amend the Consumer Fraud and Deceptive Business 2 Practices Act by changing Section 2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Consumer Fraud and Deceptive Business 6 Practices Act is amended by changing Section 2 as follows: 7 (815 ILCS 505/2) (from Ch. 121 1/2, par. 262) 8 Sec. 2. Unlawful practice; federal law. Unfair methods 9 of competition and unfair or deceptive acts or practices, 10 including but not limited to the use or employment of any 11 deception, fraud, false pretense, false promise, or 12 misrepresentation, or the concealment, suppression, or 13 omission of any material fact, with intent that others rely 14 upon the concealment, suppression, or omission of such 15 material fact, or the use or employment of any practice 16 described in Section 2 of the"Uniform Deceptive Trade 17 Practices Act", approved August 5, 1965, in the conduct of 18 any trade or commerce are hereby declared unlawful whether 19 any person has in fact been misled, deceived, or damaged 20 thereby. In construing this Section, consideration shall be 21 given to the interpretations of the Federal Trade Commission 22 and the federal courts relating to Section 5 (a) of the 23 Federal Trade Commission Act. 24 (Source: P.A. 78-904.)
