91_HB1187 LRB9103642MWgc 1 AN ACT concerning budget items for a South Suburban 2 Airport, amending named Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Civil Administrative Code of Illinois is 6 amended by changing Section 38.1 as follows: 7 (15 ILCS 20/38.1) (from Ch. 127, par. 38.1) 8 Sec. 38.1. The budget shall be submitted by the Governor 9 with line item and program data. The budget shall also 10 contain performance data presenting an estimate for the 11 current fiscal year, projections for the budget year and 12 information for the 3 prior fiscal years comparing department 13 objectives with actual accomplishments, formulated according 14 to the various functions and activities, and, wherever the 15 nature of the work admits, according to the work units, for 16 which the respective departments, offices and institutions of 17 the State government (including the elective officers in the 18 executive department and including the University of Illinois 19 and the judicial department) are responsible. For the fiscal 20 year beginning July 1, 1992 and for each fiscal year 21 thereafter, the budget shall include the performance measures 22 of each department's accountability report. For the fiscal 23 year beginning July 1, 1997 and for each fiscal year 24 thereafter, the budget shall include one or more line items 25 appropriating moneys to the Department of Human Services to 26 fund participation in the Home-Based Support Services Program 27 for Mentally Disabled Adults under the Developmental 28 Disability and Mental Disability Services Act by persons 29 described in Section 2-17 of that Act. The budget shall 30 contain a capital development Section in which the Governor 31 will present (1) information on the capital projects and -2- LRB9103642MWgc 1 capital programs for which appropriations are requested and 2 (2) the capital spending plans, which shall document the 3 first and subsequent years cash requirements by fund for the 4 proposed bonded program and (3) a statement which shall 5 identify by year the principal and interest costs until 6 retirement of the State's general obligation debt. In 7 addition, the principal and interest costs of the budget year 8 program shall be presented separately, to indicate the 9 marginal cost of principal and interest payments necessary to 10 retire the additional bonds needed to finance the budget 11 year's capital program. For the budget year, the current 12 year, and three prior fiscal years, the Governor shall also 13 include in the budget estimates of or actual values for the 14 assets and liabilities for General Assembly Retirement 15 System, State Employees' Retirement System of Illinois, State 16 Universities Retirement System, Teachers' Retirement System 17 of the State of Illinois, and Judges Retirement System of 18 Illinois. For the fiscal year beginning July 1, 1999 and for 19 each fiscal year thereafter, the budget shall include a 20 separate line item for each expenditure related to the 21 development of a South Suburban Airport appropriated to the 22 Department of Transportation and each line item shall specify 23 the object and purpose of the appropriation. Expenditures 24 related to the development of a South Suburban Airport 25 include studies, land purchases, construction, administrative 26 costs, and grants to municipalities and regional associations 27 for feasibility determinations. The budget submitted by the 28 Governor shall contain, in addition, in a separate book, a 29 tabulation of all position and employment titles in each such 30 department, office and institution, the number of each, and 31 the salaries for each, formulated according to divisions, 32 bureaus, sections, offices, departments, boards, and similar 33 subdivisions, which shall correspond as nearly as practicable 34 to the functions and activities for which the department, -3- LRB9103642MWgc 1 office or institution is responsible. Together with such 2 budget, the Governor shall transmit the estimates of receipts 3 and expenditures, as received by the director of the Bureau 4 of the Budget, of the elective officers in the executive and 5 judicial departments and of the University of Illinois. 6 (Source: P.A. 89-425, eff. 6-1-96; 89-507, eff. 7-1-97.) 7 Section 10. The State Finance Act is amended by changing 8 Section 13.2 as follows: 9 (30 ILCS 105/13.2) (from Ch. 127, par. 149.2) 10 Sec. 13.2. Transfers among line item appropriations. 11 (a) Transfers among line item appropriations from the 12 same treasury fund for the objects specified in this Section 13 may be made in the manner provided in this Section when the 14 balance remaining in one or more such line item 15 appropriations is insufficient for the purpose for which the 16 appropriation was made. 17 No transfers may be made from one agency to another 18 agency, nor may transfers be made from one institution of 19 higher education to another institution of higher education. 20 Transfers may be made only among the objects of expenditure 21 enumerated in this Section, except that no funds may be 22 transferred from any appropriation for personal services, 23 from any appropriation for State contributions to the State 24 Employees' Retirement System, from any separate appropriation 25 for employee retirement contributions paid by the employer, 26 nor from any appropriation for State contribution for 27 employee group insurance. Further, if an agency receives a 28 separate appropriation for employee retirement contributions 29 paid by the employer, any transfer by that agency into an 30 appropriation for personal services must be accompanied by a 31 corresponding transfer into the appropriation for employee 32 retirement contributions paid by the employer, in an amount -4- LRB9103642MWgc 1 sufficient to meet the employer share of the employee 2 contributions required to be remitted to the retirement 3 system. 4 (b) In addition to the general transfer authority 5 provided under subsection (c), the following agencies have 6 the specific transfer authority granted in this subsection: 7 The Illinois Department of Public Aid is authorized to 8 make transfers representing savings attributable to not 9 increasing grants due to the births of additional children 10 from line items for payments of cash grants to line items for 11 payments for employment and social services for the purposes 12 outlined in subsection (f) of Section 4-2 of the Illinois 13 Public Aid Code. 14 The Department of Transportation may not make transfers 15 among line item appropriations for expenditures related to 16 the development of a South Suburban Airport, which include 17 studies, land purchases, construction, administrative costs, 18 and grants to municipalities and regional associations for 19 feasibility determinations. 20 The Department of Children and Family Services is 21 authorized to make transfers not exceeding 2% of the 22 aggregate amount appropriated to it within the same treasury 23 fund for the following line items among these same line 24 items: Foster Home and Specialized Foster Care and 25 Prevention, Institutions and Group Homes and Prevention, and 26 Purchase of Adoption and Guardianship Services. 27 The Department on Aging is authorized to make transfers 28 not exceeding 2% of the aggregate amount appropriated to it 29 within the same treasury fund for the following Community 30 Care Program line items among these same line items: 31 Homemaker and Senior Companion Services, Case Coordination 32 Units, and Adult Day Care Services. 33 (c) The sum of such transfers for an agency in a fiscal 34 year shall not exceed 2% of the aggregate amount appropriated -5- LRB9103642MWgc 1 to it within the same treasury fund for the following 2 objects: Personal Services; Extra Help; Student and Inmate 3 Compensation; State Contributions to Retirement Systems; 4 State Contributions to Social Security; State Contribution 5 for Employee Group Insurance; Contractual Services; Travel; 6 Commodities; Printing; Equipment; Electronic Data Processing; 7 Operation of Automotive Equipment; Telecommunications 8 Services; Travel and Allowance for Committed, Paroled and 9 Discharged Prisoners; Library Books; Federal Matching Grants 10 for Student Loans; Refunds; Workers' Compensation, 11 Occupational Disease, and Tort Claims; and, in appropriations 12 to institutions of higher education, Awards and Grants. 13 Notwithstanding the above, any amounts appropriated for 14 payment of workers' compensation claims to an agency to which 15 the authority to evaluate, administer and pay such claims has 16 been delegated by the Department of Central Management 17 Services may be transferred to any other expenditure object 18 where such amounts exceed the amount necessary for the 19 payment of such claims. 20 (d) Transfers among appropriations made to agencies of 21 the Legislative and Judicial departments and to the 22 constitutionally elected officers in the Executive branch 23 require the approval of the officer authorized in Section 10 24 of this Act to approve and certify vouchers. Transfers among 25 appropriations made to the University of Illinois, Southern 26 Illinois University, Chicago State University, Eastern 27 Illinois University, Governors State University, Illinois 28 State University, Northeastern Illinois University, Northern 29 Illinois University, Western Illinois University, the 30 Illinois Mathematics and Science Academy and the Board of 31 Higher Education require the approval of the Board of Higher 32 Education and the Governor. Transfers among appropriations 33 to all other agencies require the approval of the Governor. 34 The officer responsible for approval shall certify that -6- LRB9103642MWgc 1 the transfer is necessary to carry out the programs and 2 purposes for which the appropriations were made by the 3 General Assembly and shall transmit to the State Comptroller 4 a certified copy of the approval which shall set forth the 5 specific amounts transferred so that the Comptroller may 6 change his records accordingly. The Comptroller shall 7 furnish the Governor with information copies of all transfers 8 approved for agencies of the Legislative and Judicial 9 departments and transfers approved by the constitutionally 10 elected officials of the Executive branch other than the 11 Governor, showing the amounts transferred and indicating the 12 dates such changes were entered on the Comptroller's records. 13 (Source: P.A. 89-4, eff. 1-1-96; 89-641, eff. 8-9-96; 90-587, 14 eff. 7-1-98.) 15 Section 99. Effective date. This Act takes effect upon 16 becoming law.
