91_HB1219 LRB9100676LDcsA 1 AN ACT in relation to alcohol, amending named Acts. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Civil Administrative Code of Illinois is 5 amended by adding Section 55.91 as follows: 6 (20 ILCS 2310/55.91 new) 7 Sec. 55.91. To inspect the premises of a retailer who 8 sells alcoholic beverages for consumption on the premises and 9 to enforce the requirement that such retailers post signs as 10 required under Section 6-32 of the Liquor Control Act of 11 1934. 12 Section 10. The Liquor Control Act of 1934 is amended by 13 adding Section 6-32 as follow: 14 (235 ILCS 5/6-32 new) 15 Sec. 6-32. Warning signs. 16 (a) A retailer who sells alcoholic beverages for 17 consumption on the premises shall post, in a conspicuous 18 place in every restroom to which females have access, a sign 19 that clearly reads: "Warning: Drinking alcoholic beverages 20 during pregnancy can cause birth defects." The sign shall 21 include a picture, occupying not less than one-half of the 22 sign, illustrating a pregnant woman and the international red 23 "prohibited" symbol over an alcoholic beverage. The 24 illustration shall be no smaller than 11 inches by 17 inches. 25 (b) The Department shall make such warning signs 26 available to retailers of alcoholic beverages and shall 27 promulgate rules with respect to the form and the posting of 28 such signs. A fee may be charged by the Department to cover 29 printing, postage, and handling expenses. -2- LRB9100676LDcsA 1 (c) A person who fails or refuses to post the sign as 2 required in this Section shall be liable for a civil fine in 3 an amount not to exceed $50 for the first violation or $100 4 for a second violation or subsequent violation. Such fine 5 shall be imposed and collected by the Department of Public 6 Health after providing the person with due process and an 7 opportunity to be heard.
