91_HB1322 LRB9103978KSpr 1 AN ACT to amend the Illinois Vehicle Code by changing 2 Section 11-303. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Vehicle Code is amended by 6 changing Section 11-303 as follows: 7 (625 ILCS 5/11-303) (from Ch. 95 1/2, par. 11-303) 8 Sec. 11-303. The Department to place signs on all State 9 highways. 10 (a) The Department shall place and maintain such 11 traffic-control devices, conforming to its manual and 12 specifications on all highways under its jurisdiction as it 13 shall deem necessary to indicate and to carry out the 14 provisions of this Chapter or to regulate, warn or guide 15 traffic. 16 (b) No local authority shall place or maintain any 17 traffic-control device upon any highway under the 18 jurisdiction of the Department except by the latter's 19 permission. 20 (c) The Department shall erect and maintain guide, 21 warning and direction signs upon highways in cities, towns 22 and villages of which portions or lanes of such highways are 23 under the control and jurisdiction of the Department or for 24 which the Department has maintenance responsibility. 25 (d) Nothing in this Chapter shall divest the corporate 26 authorities of park districts of power to prohibit or 27 restrict the use of highways under their jurisdiction by 28 certain types or weights of motor vehicles or the power of 29 cities, villages, incorporated towns and park districts to 30 designate highways for one-way traffic or the power of such 31 municipal corporations to erect and maintain appropriate -2- LRB9103978KSpr 1 signs respecting such uses. 2 (e) Nothing in this Section shall prohibit a 3 municipality, township, or county from erecting signs as 4 required under the Illinois Adopt-A-Highway Act. 5 (f) When any directional sign placed on any highway upon 6 which over 10,000 vehicles travel each day is replaced by the 7 Department for any reason, the Department shall ensure that 8 the replacement sign is large enough to be read by drivers 9 and that the sign, if placed on a multi-lane highway, is 10 placed so that a driver can safely change lanes. 11 (Source: P.A. 87-1118.)
