1 AN ACT to amend the Illinois Vehicle Code by adding
2 Section 12-612.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 adding Section 12-612 as follows:
7 (625 ILCS 5/12-612 new)
8 Sec. 12-612. Telephone; use of hands free apparatus.
9 The driver of a motor vehicle, other than a motor vehicle of
10 a law enforcement agency, may not use a telephone while
11 operating the motor vehicle unless the telephone is equipped
12 with and the driver uses an apparatus that allows the driver
13 to talk and listen without holding the telephone or its
14 handset or receiver. The driver may not hold or touch the
15 telephone or its handset or receiver while operating the
16 motor vehicle except to enable the apparatus, enter a
17 telephone number, or hang up or turn off the telephone. As
18 used in this Section, "telephone" means a cellular telephone,
19 portable telephone, or other telephone that may be used from
20 within a moving motor vehicle.
