91_HB1498 LRB9103091MWgc 1 AN ACT concerning annual stipends for certain county 2 officers, amending named Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Property Tax Code is amended by changing 6 Section 3-40 as follows: 7 (35 ILCS 200/3-40) 8 Sec. 3-40. Compensation of supervisors of assessments. 9 (a) A supervisor of assessments shall receive annual 10 compensation in an amount fixed by the county board subject 11 to the following minimum amounts: 12 In counties with less than 14,000 inhabitants, not 13 less than $7,500; 14 In counties with 14,000 or more but less than 30,000 15 inhabitants, not less than $8,000; 16 In counties with 30,000 or more but less than 60,000 17 inhabitants, not less than $9,000; 18 In counties with 60,000 or more but less than 19 100,000 inhabitants, not less than $10,000; 20 In counties with 100,000 or more but less than 21 200,000 inhabitants, not less than $11,500; 22 In counties with 200,000 or more but less than 23 300,000 inhabitants, not less than $13,000; 24 In counties with 300,000 or more but less than 25 1,000,000 inhabitants, not less than $15,000. 26 For purposes of this subsection, the number of inhabitants 27 shall be determined by the latest Federal decennial or 28 special census of the county. 29 (b) Elected supervisors of assessments who began a term 30 of office before December 1, 1990 shall be compensated at the 31 rate of their base salary. "Base salary" is the compensation -2- LRB9103091MWgc 1 paid for their position before July 1, 1989. 2 (c) Elected supervisors of assessments beginning a term 3 of office on or after December 1, 1990 shall, beginning 4 December 1, 1993, receive their base salary plus at least 12% 5 of base salary. 6 Any supervisor of assessments who has been presented a 7 Certified Assessing Evaluator Certificate by the 8 International Association of Assessing Officers shall receive 9 an additional compensation of $500 per year to be paid out of 10 funds appropriated to the Department. 11 The salary set by the county board shall be paid in equal 12 monthly installments out of the treasury of the county in 13 which he or she is appointed or elected. If the Department 14 has determined that the total assessed value of property in a 15 county, as equalized by the supervisor of assessments under 16 Section 9-210, is between 31 1/3% and 35 1/3% of the total 17 fair cash value of property in the county, the State of 18 Illinois shall reimburse the county monthly from the State 19 treasury 50% of the amount of salary the county paid to the 20 officer for the preceding month. 21 In addition to, but separate and apart from, the 22 compensation provided in this Section, the supervisor of 23 assessments of each county shall receive an annual stipend of 24 $6,500 to be paid by the State if his or her term begins on 25 or after December 1, 2000. 26 The county board shall provide necessary office space for 27 the officer and pay all necessary expenses of the office out 28 of the county treasury. 29 Each supervisor of assessments may, with the advice and 30 consent of the county board, appoint necessary deputies and 31 clerks, their compensation to be fixed by the county board 32 and paid by the county. 33 (Source: P.A. 86-482; 86-1475; 88-455.) -3- LRB9103091MWgc 1 Section 10. The Counties Code is amended by changing 2 Sections 4-6001 and 4-6002 as follows: 3 (55 ILCS 5/4-6001) (from Ch. 34, par. 4-6001) 4 Sec. 4-6001. Officers in counties of less than 5 2,000,000. 6 (a) In all counties of less than 2,000,000 inhabitants, 7 the compensation of Coroners, County Treasurers, County 8 Clerks, Recorders and Auditors shall be determined under this 9 Section. The County Board in those counties shall fix the 10 amount of the necessary clerk hire, stationery, fuel and 11 other expenses of those officers. The compensation of those 12 officers shall be separate from the necessary clerk hire, 13 stationery, fuel and other expenses, and such compensation 14 (except for coroners in those counties with less than 15 2,000,000 population in which the coroner's compensation is 16 set in accordance with Section 4-6002) shall be fixed within 17 the following limits: 18 To each such officer in counties containing less than 19 14,000 inhabitants, not less than $13,500 per annum. 20 To each such officer in counties containing 14,000 or 21 more inhabitants, but less than 30,000 inhabitants, not less 22 than $14,500 per annum. 23 To each such officer in counties containing 30,000 or 24 more inhabitants but less than 60,000 inhabitants, not less 25 than $15,000 per annum. 26 To each such officer in counties containing 60,000 or 27 more inhabitants but less than 100,000 inhabitants, not less 28 than $15,000 per annum. 29 To each such officer in counties containing 100,000 or 30 more inhabitants but less than 200,000 inhabitants, not less 31 than $16,500 per annum. 32 To each such officer in counties containing 200,000 or 33 more inhabitants but less than 300,000 inhabitants, not less -4- LRB9103091MWgc 1 than $18,000 per annum. 2 To each such officer in counties containing 300,000 or 3 more inhabitants but less than 2,000,000 inhabitants, not 4 less than $20,000 per annum. 5 (b) Those officers beginning a term of office before 6 December 1, 1990 shall be compensated at the rate of their 7 base salary. "Base salary" is the compensation paid for each 8 of those offices, respectively, before July 1, 1989. 9 (c) Those officers beginning a term of office on or 10 after December 1, 1990 shall be compensated as follows: 11 (1) Beginning December 1, 1990, base salary plus at 12 least 3% of base salary. 13 (2) Beginning December 1, 1991, base salary plus at 14 least 6% of base salary. 15 (3) Beginning December 1, 1992, base salary plus at 16 least 9% of base salary. 17 (4) Beginning December 1, 1993, base salary plus at 18 least 12% of base salary. 19 (d) In addition to but separate and apart from the 20 compensation provided in this Section, the county clerk of 21 each county, the recorder of each county, and the chief clerk 22 of each county board of election commissioners shall receive 23 an award as follows: 24 (1) $4,500 per year after January 1, 1998; 25 (2) $5,500 per year after January 1, 1999; and 26 (3) $6,500 per year after January 1, 2000. 27 The total amount required for such awards each year shall be 28 appropriated by the General Assembly to the State Board of 29 Elections which shall distribute the awards in annual lump 30 sum payments to the several county clerks, recorders, and 31 chief election clerks. Beginning December 1, 1990, this 32 annual award, and any other award or stipend paid out of 33 State funds to county officers, shall not affect any other 34 compensation provided by law to be paid to county officers. -5- LRB9103091MWgc 1 (d-5) In addition to, but separate and apart from, the 2 compensation provided in this Section, the auditor of each 3 county shall receive an annual stipend of $6,500 to be paid 4 by the State if his or her term begins on or after December 5 1, 2000. 6 (e) Beginning December 1, 1990, no county board may 7 reduce or otherwise impair the compensation payable from 8 county funds to a county officer if the reduction or 9 impairment is the result of the county officer receiving an 10 award or stipend payable from State funds. 11 (f) The compensation, necessary clerk hire, stationery, 12 fuel and other expenses of the county auditor, as fixed by 13 the county board, shall be paid by the county. 14 (g) The population of all counties for the purpose of 15 fixing compensation, as herein provided, shall be based upon 16 the last Federal census immediately previous to the election 17 of the officer in question in each county. 18 (Source: P.A. 90-713, eff. 12-1-98.) 19 (55 ILCS 5/4-6002) (from Ch. 34, par. 4-6002) 20 Sec. 4-6002. Coroners in counties of less than 2,000,000. 21 (a) The County Board, in all counties of less than 2,000,000 22 inhabitants, shall fix the compensation of Coroners within 23 the limitations fixed by this Division, and shall appropriate 24 for their necessary clerk hire, stationery, fuel, supplies, 25 and other expenses. The compensation of the Coroner shall be 26 fixed separately from his necessary clerk hire, stationery, 27 fuel and other expenses, and such compensation shall be fixed 28 within the following limits: 29 To each Coroner in counties containing less than 5,000 30 inhabitants, not less than $4,500 per annum. 31 To each Coroner in counties containing 5,000 or more 32 inhabitants but less than 14,000 inhabitants, not less than 33 $6,000 per annum. -6- LRB9103091MWgc 1 To each Coroner in counties containing 14,000 or more 2 inhabitants, but less than 30,000 inhabitants, not less than 3 $9,000 per annum. 4 To each Coroner in counties containing 30,000 or more 5 inhabitants, but less than 60,000 inhabitants, not less than 6 $14,000 per annum. 7 To each Coroner in counties containing 60,000 or more 8 inhabitants, but less than 100,000 inhabitants, not less than 9 $15,000 per annum. 10 To each Coroner in counties containing 100,000 or more 11 inhabitants, but less than 200,000 inhabitants, not less than 12 $16,500 per annum. 13 To each Coroner in counties containing 200,000 or more 14 inhabitants, but less than 300,000 inhabitants, not less than 15 $18,000 per annum. 16 To each Coroner in counties containing 300,000 or more 17 inhabitants, but less than 2,000,000 inhabitants, not less 18 than $20,000 per annum. 19 The population of all counties for the purpose of fixing 20 compensation, as herein provided, shall be based upon the 21 last Federal census immediately previous to the election of 22 the Coroner in question in each county. This Section does not 23 apply to a county which has abolished the elective office of 24 coroner. 25 (b) Those coroners beginning a term of office on or 26 after December 1, 1990 shall be compensated as follows: 27 (1) Beginning December 1, 1990, base salary plus at 28 least 3% of base salary. 29 (2) Beginning December 1, 1991, base salary plus at 30 least 6% of base salary. 31 (3) Beginning December 1, 1992, base salary plus at 32 least 9% of base salary. 33 (4) Beginning December 1, 1993, base salary plus at 34 least 12% of base salary. -7- LRB9103091MWgc 1 "Base salary", as used in this subsection (b), means the 2 salary in effect before July 1, 1989. 3 (c) In addition to, but separate and apart from, the 4 compensation provided in this Section, the coroner of each 5 county shall receive an annual stipend of $6,500 to be paid 6 by the State if his or her term begins on or after December 7 1, 2000. 8 (Source: P.A. 86-962; 86-1028.) 9 Section 99. Effective date. This Act takes effect upon 10 becoming law.
