91_HB1509eng HB1509 Engrossed LRB9104058MWks 1 AN ACT to amend the Illinois Procurement Code by changing 2 Section 35-35. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Procurement Code is amended by 6 changing Section 35-35 as follows: 7 (30 ILCS 500/35-35) 8 Sec. 35-35. Exceptions. 9 (a) Exceptions to Section 35-30 are allowed for sole 10 source procurements, emergency procurements, and at the 11 discretion of the chief procurement officer or the State 12 purchasing officer, but not their designees, for professional 13 and artistic contracts that are nonrenewable, one year or 14 less in duration, and have a value of less than $20,000. 15 (b) All exceptions granted under this Article must still 16 be submitted to the Department of Central Management Services 17 or the higher education chief procurement officer, whichever 18 is appropriate, and published as provided for in subsection 19 (f) of Section 35-30, shall name the authorizing chief 20 procurement officer or State purchasing officer, and shall 21 include a brief explanation of the reason for the exception. 22 (c) Exemptions to Section 35-30 are allowed for 23 contracts between a State agency and a private not-for-profit 24 university for the service of an individual, affiliated with 25 that university, to carry out highly specialized medical, 26 technical, or social services within and under the direction 27 and supervision of that agency. 28 (Source: P.A. 90-572, eff. date - See Sec. 99-5.)
