Amend House Bill 1700, AS AMENDED, 3 by replacing the title with the following: 4 "AN ACT to amend the Liquor Control Act of 1934 by 5 changing Section 7-6."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Liquor Control Act of 1934 is amended by 9 changing Section 7-6 as follows: 10 (235 ILCS 5/7-6) (from Ch. 43, par. 150) 11 Sec. 7-6. All proceedings for the revocation or 12 suspension of licenses of manufacturers, distributors, 13 importing distributors, non-resident dealers, foreign 14 importers, non-beverage users, railroads, airplanes and boats 15 shall be before the State Commission. All such proceedings 16 and all proceedings for the revocation or suspension of a 17 retailer's license before the State commission shall be in 18 accordance with rules and regulations established by it not 19 inconsistent with law. However, no such license shall be so 20 revoked or suspended except after a hearing by the State 21 commission with reasonable notice to the licensee served by -2- LRB9103063LDmbam03 1 registered or certified mail with return receipt requested at 2 least 105days prior to the hearings at the last known place 3 of business of the licensee and after an opportunity to 4 appear and defend. Such notice shall specify the time and 5 place of the hearing,andthe nature of the charges, the 6 specific provisions of the Act and rules violated, and the 7 specific facts supporting the charges or violation. The 8 findings of the Commission shall be predicated upon competent 9 evidence. The revocation of a local license shall 10 automatically result in the revocation of a State license. 11 All procedures for the suspension or revocation of a license, 12 as enumerated above, are applicable to the levying of fines 13 for violations of this Act or any rule or regulation issued 14 pursuant thereto. 15 (Source: P.A. 82-783.) 16 Section 99. Effective date. This Act takes effect upon 17 becoming law.".
