1 AMENDMENT TO HOUSE BILL 2104
2 AMENDMENT NO. . Amend House Bill 2104 by replacing
3 the title with the following:
4 "AN ACT concerning property."; and
5 by replacing everything after the enacting clause with the
6 following:
7 "Section 5. The Conveyances Act is amended by adding
8 Section 38c as follows:
9 (765 ILCS 5/38c new)
10 Sec. 38c. Townhome declarations.
11 (a) The declarations of a noncondominium townhome
12 instrument concerning common interest property must provide
13 that maintenance assessments for a townhome must be
14 consistent with the following factors, when considered
15 together: (i) the square footage of the townhome in relation
16 to the square footage of other townhomes in the common
17 interest property community, (ii) the equalized assessed
18 value of the townhome in relation to the equalized assessed
19 value of the other townhomes in the common interest property
20 community, and (iii) the special assessments of the townhome
21 for insurance premiums in relation to those special

1 assessments for other townhomes in the common interest
2 property community.
3 (b) For the purposes of this Section:
4 "Common interest property" means real estate with respect
5 to which any person by virtue of his or her ownership of a
6 partial interest or unit in the property is obligated to pay
7 for maintenance, improvement, insurance premiums, or real
8 estate taxes of other real estate described in a declaration
9 that is administered by an association.
10 "Noncondominium townhome" means a common interest
11 property community that is not established under the
12 Condominium Property Act.".
