91_HB2149 LRB9105029DHmg 1 AN ACT to amend the Secretary of State Act by changing 2 Section 5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Secretary of State Act is amended by 6 changing Section 5 as follows: 7 (15 ILCS 305/5) (from Ch. 124, par. 5) 8 Sec. 5. Duties. It shall be the duty of the Secretary 9 of State: 10 1. To countersign and affix the seal of state to all 11 commissions required by law to be issued by the Governor. 12 2. To make a register of all appointments by the 13 Governor, specifying the person appointed, the office 14 conferred, the date of the appointment, the date when bond or 15 oath is taken and the date filed. If Senate confirmation is 16 required, the date of the confirmation shall be included in 17 the register. 18 3. To make proper indexes to public acts, resolutions, 19 papers and documents in his office. 20 3-a. To review all rules of all State agencies adopted 21 in compliance with the codification system prescribed by the 22 Secretary. The review shall be for the purposes and include 23 all the powers and duties provided in the Illinois 24 Administrative Procedure Act. The Secretary of State shall 25 cooperate with the Legislative Information System to insure 26 the accuracy of the text of the rules maintained under the 27 Legislative Information System Act. 28 4. To give any person requiring the same paying the 29 lawful fees therefor, a copy of any law, act, resolution, 30 record or paper in his office, and attach thereto his 31 certificate, under the seal of the state. -2- LRB9105029DHmg 1 5. To take charge of and preserve from waste, and keep 2 in repair, the houses, lots, grounds and appurtenances, 3 situated in the City of Springfield, and belonging to or 4 occupied by the State, the care of which is not otherwise 5 provided for by law, and to take charge of and preserve from 6 waste, and keep in repair, the houses, lots, grounds and 7 appurtenances, situated in the State outside the City of 8 Springfield where such houses, lots, grounds and 9 appurtenances are occupied by the Secretary of State and no 10 other State officer or agency. 11 6. To supervise the distribution of the laws. 12 7. To perform such other duties as may be required by 13 law. The Secretary of State may, within appropriations 14 authorized by the General Assembly, maintain offices in the 15 State Capital and in such other places in the State as he may 16 deem necessary to properly carry out the powers and duties 17 vested in him by law. 18 8.
