1 AN ACT to amend the Illinois Underground Utility
2 Facilities Damage Prevention Act by changing Section 5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Underground Utility Facilities
6 Damage Prevention Act is amended by changing Section 5.

8 Sec. 5. Preconstruction conference. When the Illinois
9 Department of Transportation notifies an owner or operator of
10 an underground utility facility or CATS facility that the
11 Department will conduct a preconstruction conference
12 concerning new construction, reconstruction, or maintenance
13 of State highways in and near the area in which such owner or
14 operator has placed underground utility facilities, such
15 notification shall, except as otherwise provided in this
16 Section constitute compliance by the Department or its
17 contractors with paragraphs (a), (b), and (c) of Section 4 of
18 this Act. In instances when notification of a
19 preconstruction conference is provided to the owner or
20 operator of an underground utility facility or CATS facility
21 but no specific date is established at the preconstruction
22 conference for the new construction, reconstruction or
23 maintenance of State highways in and near the area in which
24 the owner or operator has placed underground utility
25 facilities or CATS facilities, then the Department or its
26 contractors shall later comply with paragraph (c) of Section
27 4 of this Act.
