91_HB2228 LRB9103285JSpc 1 AN ACT to amend the Illinois Underground Utility 2 Facilities Damage Prevention Act by changing Section 4. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Underground Utility Facilities 6 Damage Prevention Act is amended by changing Section 4 as 7 follows: 8 (220 ILCS 50/4) (from Ch. 111 2/3, par. 1604) 9 Sec. 4. Required activities. AEveryperson who engages 10 in nonemergency excavation or demolition shall: 11 (a) take reasonable action to inform himself of the 12 location of any underground utility facilities or CATS 13 facilities in and near the area for which such operation is 14 to be conducted; 15 (b) plan the excavation or demolition to avoid or 16 minimize interference with underground utility facilities or 17 CATS facilities in and near the construction area; 18 (c) provide notice not more than 14 days nor less than 19 48 hours (exclusive of Saturdays, Sundays and holidays) in 20 advance of the start of the excavation or demolition to the 21 owners or operators of the underground utility facilities or 22 CATS facilities in and near the excavation or demolition area 23 through the State-Wide One-Call Notice System or, in the case 24 of nonemergency excavation or demolition within the 25 boundaries of a municipality of at least one million persons 26 which operates its own one-call notice system, through the 27 one-call notice system which operates in that municipality; 28 (d) provide, during and following excavation or 29 demolition, such support for existing underground utility 30 facilities or CATS facilities in and near the excavation or 31 demolition area as may be reasonably necessary for the -2- LRB9103285JSpc 1 protection of such facilities unless otherwise agreed to by 2 the owner or operator of the underground facility or CATS 3 facility; and 4 (e) backfill all excavations in such manner and with 5 such materials as may be reasonably necessary for the 6 protection of existing underground utility facilities or CATS 7 facilities in and near the excavation or demolition area. 8 At a minimum, the notice required under clause (c) shall 9 provide: 10 (1) the person's name, address, and (i) phone 11 number at which a message can be left or (ii) fax number; 12 (2) the start date of the planned excavation or 13 demolition; 14 (3) the address at which the excavation or 15 demolition will take place; and 16 (4) the type and extent of the work involved. 17 (Source: P.A. 87-125; 88-578, effective date changed to 18 7-1-95 by P.A. 88-681.)
