1 AN ACT to amend the Nursing Home Care Act by adding
2 Section 3-602.1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Nursing Home Care Act is amended by adding
6 Section 3-602.1 as follows:
7 (210 ILCS 45/3-602.1 new)
8 Sec. 3-602.1. Punitive Damages. A court may award
9 punitive damages in an action against a facility for wilful
10 or wanton misconduct of the facility's agents or employees
11 that results in the injury or death of a resident.
12 Section 99. Effective date. This Act takes effect upon
13 becoming law.
