1 AN ACT to amend the Fire Protection District Act by
2 changing Section 1.01.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Fire Protection District Act is amended
6 by changing Section 1.01 as follows:
7 (70 ILCS 705/1.01) (from Ch. 127 1/2, par. 21a)
8 Sec. 1.01. Election against organization. Where an
9 election has been held to organize any territory as a Fire
10 Protection District under this Act, at which election a
11 majority of the votes cast in the territory proposed to be
12 organized was against the organization of a Fire Protection
13 District, or in case a city, village, or incorporated town is
14 in the territory sought to be organized, then if the
15 proposition failed to receive a majority of the votes cast
16 either in the such city, village or incorporated town or in
17 the territory outside of the such city, village, or
18 incorporated town, then no subsequent election shall be held
19 to organize the such territory, or any part thereof, into a
20 Fire Protection District for a period of one year after the
21 such election.
