91_HB2563 LRB9104939RCks 1 AN ACT to amend the Code of Criminal Procedure of 1963 by 2 adding Section 115-21. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Code of Criminal Procedure of 1963 is 6 amended by adding Section 115-21 as follows: 7 (725 ILCS 5/115-21 new) 8 Sec. 115-21. Prima facie evidence. 9 (a) It is prima facie evidence that a person committed a 10 Class A misdemeanor violation of Section 4 of the Cannabis 11 Control Act if he or she is an inmate of a correctional 12 institution of the Department of Corrections and tested 13 positive for cannabis. 14 (b) It is prima facie evidence that a person committed a 15 Class 4 felony violation of Section 402 of the Illinois 16 Controlled Substances Act if he or she is an inmate of a 17 correctional institution of the Department of Corrections and 18 tested positive for a controlled substance.
