91_HB2644enr HB2644 Enrolled LRB9101612ACmb 1 AN ACT concerning the regulation of professions, amending 2 named Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Dietetic and Nutrition Services Practice 6 Act is amended by changing Section 85 as follows: 7 (225 ILCS 30/85) (from Ch. 111, par. 8401-85) 8 Sec. 85. Fees. The Department shall provide by rule for 9 a schedule of fees for the administration and enforcement of 10 this Act, including but not limited to original licensure, 11 renewal, and restoration. The fees shall be nonrefundable. 12 All fees collected under this Act shall be deposited into 13 the General Professions Dedicated Fund and shall be 14 appropriated to the Department for the ordinary and 15 contingent expenses of the Department in the administration 16 of this Act.The following fees shall be imposed by the17Department and are not refundable:18(a) A fee of $100 must accompany an application for a19license under this Act.20(b) In addition, applicants for any examination as a21dietitian shall be required to pay, either to the Department22or to the designated testing service, a fee covering the cost23of providing the examination. Failure to appear for the24examination on the scheduled date, at the time and place25specified, after the applicant's application for the26examination has been received and acknowledged by the27Department or the designated testing service, shall result in28the forfeiture of the examination fee.29(c) The fee for the renewal of a license as a dietitian30or nutrition counselor shall be $50 per year.31(d) The fee for application for a license for aHB2644 Enrolled -2- LRB9101612ACmb 1dietitian or nutrition counselor licensed under the laws of2another jurisdiction is $200.3(e) The fee for the restoration of a license other than4from inactive status is $25 plus payment of all lapsed5renewal fees.6(f) The fee for the issuance of a duplicate license, for7the issuance of a replacement registration for a license that8has been lost or destroyed, or for the issuance of a license9with a change of name or address other than during the10renewal period is $25. No fee is required for name and11address changed on Department records where a duplicate12registration is not issued.13(g) The fee for certification of a license for any14purpose is $25.15(h) The fee to have the scoring of an examination16administered by the Department reviewed and verified is $2517plus any fees charged by the applicable testing service.18(i) The fee for a wall certificate showing a license19shall be the actual cost of producing the certificate.20(j) The fee for a roster of licensees as dietitians or21nutrition counselors in this State shall be the actual cost22of producing the roster.23(k) The fee for initial approval of a continuing24education sponsor shall be $500. The fee for renewal of25sponsor approval shall be $250 every 2 years. State colleges,26universities, and State agencies located in Illinois are27exempt from payment of this fee.28 (Source: P.A. 87-784; 87-1000.) 29 Section 10. The Environmental Health Practitioner 30 Licensing Act is amended by changing Section 28 as follows: 31 (225 ILCS 37/28) 32 Sec. 28. Fees. The Department shall provide by rule for HB2644 Enrolled -3- LRB9101612ACmb 1 a schedule of fees for the administration and enforcement of 2 this Act, including but not limited to original licensure, 3 renewal, and restoration. The fees shall be nonrefundable. 4The fees imposed under this Act are as follows and are5nonrefundable:6(1) The fee for application for an environmental health7practitioner license is $100.8(2) Applicants for examination shall pay, either to the9Department or to the designated testing service, a fee10covering the cost of providing the examination.11(3) The fee for renewal of a license is $110 per year.12(4) The fee for reinstatement of a license that has13expired for less than 5 years is $20, plus payment of all14unpaid fees for every year that has lapsed.15(5) The fee for the restoration of a license, other than16from inactive status, is $10 plus payment of all lapsed17renewal fees.18(6) The fee for the restoration of a license that has19expired for more than 5 years is $300.20(7) The fee for issuance of a duplicate license, a21replacement license that has been lost or destroyed, or a22license with a change of name or address, other than during23the renewal period, is $20. No fee is required for name and24address changes on Department records when no duplicate25license is issued.26(8) The fee for certification of a license for any27purpose is $20.28(9) The fee for a wall certificate showing the granting29of a license shall be the actual cost of producing the30certificate.31(10) The fee for a roster of persons licensed as32environmental health practitioners in this State shall be the33actual cost of production of the roster.34(11) The fee for a sponsor of continuing education shallHB2644 Enrolled -4- LRB9101612ACmb 1be set by rule.2 (Source: P.A. 89-61, eff. 6-30-95.) 3 Section 15. The Funeral Directors and Embalmers 4 Licensing Code is amended by changing Section 15-65 as 5 follows: 6 (225 ILCS 41/15-65) 7 Sec. 15-65. Fees. The Department shall provide by rule 8 for a schedule of fees for the administration and enforcement 9 of this Act, including but not limited to original licensure, 10 renewal, and restoration. The fees shall be nonrefundable. 11 All fees collected under this Act shall be deposited into 12 the General Professions Dedicated Fund and shall be 13 appropriated to the Department for the ordinary and 14 contingent expenses of the Department in the administration 15 of this Act.The following fees shall be paid to the16Department for the licensing and registration functions17performed by the Department under this Code:18(A) License of funeral director and embalmer trainee.19(1) The fee to be paid by an applicant for a20license as a funeral director and embalmer trainee is21$50.22(2) The fee to be paid upon the renewal of a23license as a funeral director and embalmer trainee is24$100.25(B) License of funeral director and embalmer or funeral26director.27(1) The fee to be paid by an applicant for a28license as a funeral director and embalmer is $100. The29Department may provide for examination fees to be paid30directly to a designated testing service.31(2) The fee to be paid by an applicant for a32license as a funeral director and embalmer licensed underHB2644 Enrolled -5- LRB9101612ACmb 1the laws of another State or territory of the United2States or of a foreign country or province is $200.3(3) The fee to be paid upon the renewal of a4license as a funeral director and embalmer is $100; and5$50 for a funeral director.6(4) The fee to be paid for the reinstatement of a7license as a funeral director and embalmer or funeral8director that has been expired for not more than 5 years9is $10 plus all lapsed renewal fees.10(5) The fee to be paid for the restoration of a11license as a funeral director and embalmer that has been12expired for more than 5 years is $260; and $130 for a13funeral director.14(6) The fee to place a license on inactive status15is $20.16(C) General fees.17(1) The fee to be paid for the issuance of a18duplicate license, for the issuance of a replacement19license for a license which has been lost or destroyed or20for the issuance of a license with a change of name or21address other than during the renewal period is $10.22(2) The fee to be paid for a certification of a23licensee's record for any purpose is $10.24(3) The fee to be paid to have the scoring of an25examination administered by the Department reviewed and26verified is $10.27(4) The fee to be paid by a licensee for a wall28certificate showing the license shall be the actual cost29of producing the certificate.30(5) The fee to be paid for a roster of persons31licensed as funeral directors, funeral directors and32embalmers, or funeral director and embalmer trainees in33this State shall be the actual cost of producing the34roster.HB2644 Enrolled -6- LRB9101612ACmb 1(6) The fee to be paid to the Department for a2printed copy of this Code and of the rules and3regulations promulgated for the administration of this4Code is $1.5 (Source: P.A. 87-966.) 6 Section 20. The Illinois Physical Therapy Act is amended 7 by changing Section 16.1 as follows: 8 (225 ILCS 90/16.1) 9 Sec. 16.1. Fees. The Department shall provide by rule a 10 schedule of fees for the administration and enforcement of 11 this Act, including but not limited to original licensure, 12 renewal, and restoration. The fees shall be nonrefundable. 13(a) The application fee for a license is $100.14(b) Applicants for any examination shall be required to15pay, either to the Department or to the designated testing16service, a fee covering the cost of determining an17applicant's eligibility and providing the examination.18Failure to appear for the examination on the scheduled date,19at the time and place specified, after the applicant's20application for examination has been received and21acknowledged by the Department or the designated testing22service, shall result in the forfeiture of the examination23fee.24(c) The fee for the renewal of a license shall be25calculated at the rate of $30 per year.26(d) The fee for the restoration of a license other than27from inactive status is $10 plus payment of all lapsed28renewal fees.29(e) The fee to be paid for the issuance of a duplicate30license, for the issuance of a replacement license, for a31replacement license for a license that has been lost or32destroyed, or for the issuance of a license with a change ofHB2644 Enrolled -7- LRB9101612ACmb 1name or address other than during the renewal period is $20.2(f) The fee for a certification of a license for any3purpose is $20.4(g) The fee to have the scoring of an examination5administered by the Department reviewed and verified is $206plus any fee charged by the applicable testing service.7(h) The fee for a wall certificate evidencing licensing8shall be the actual cost of producing that certificate.9(i) The fee for a roster of persons licensed as physical10therapists or physical therapists assistants in this State11shall be the actual cost of producing that roster.12 (Source: P.A. 89-387, eff. 1-1-96.) 13 Section 25. The Respiratory Care Practice Act is amended 14 by changing Section 75 as follows: 15 (225 ILCS 106/75) 16 Sec. 75. Fees. The Department shall provide by rule 17 for a schedule of fees for the administration and enforcement 18 of this Act, including but not limited to original licensure, 19 renewal, and restoration. The fees shall be nonrefundable. 20The fees imposed under this Act are as follows and are21nonrefundable:22(a) The fee for application for a respiratory care23practitioner license is $100.24(b) The fee for application for a temporary license is25$50 per year.26(c) Applicants for examination shall pay, either to the27Department or to the designated testing service, a fee28covering the cost of providing the examination.29(d) The fee for the renewal of a license is $60 per30year.31(e) The fee for the reinstatement of a license that has32been expired for less than 5 years is $20, plus payment ofHB2644 Enrolled -8- LRB9101612ACmb 1all unpaid fees for every year that has lapsed.2(f) The fee for the restoration of a license that has3been expired for more than 5 years is $300.4(g) The fee for the issuance of a duplicate license, the5issuance of a replacement for a license that has been lost or6destroyed, or the issuance of a license with a change of name7or address, other than during the renewal period, is $20. No8fee is required for name and address changes on Department9records when no duplicate registration is issued.10(h) The fee for the certification of a license for any11purpose is $20.12(i) The fee for rescoring an examination is the cost to13the Department of rescoring the examination, plus any fees14charged by the applicable testing service to have the15examination rescored.16(j) The fee for a wall certificate showing the license17is the actual cost of producing the certificate.18(k) The fee for a roster of persons licensed as19respiratory care practitioners in this State is the actual20cost of producing the roster.21(l) The fee for copies of a license shall be the actual22cost of producing the copies.23(m) The fee for application for a license by a24respiratory care practitioner registered or licensed under25the laws of another jurisdiction is $100.26 All of the fees collected under this Act shall be 27 deposited into the General Professions Dedicated Fund. The 28 monies deposited into the General Professions Dedicated Fund 29 shall be used by the Department, as appropriated, for the 30 ordinary and contingent expenses of the Department. Monies 31 in the General Professions Dedicated Fund may be invested and 32 reinvested, with all earnings received from investments to be 33 deposited into that Fund and used for the same purposes as 34 fees deposited in that Fund. The Veterinary Medicine and Surgery Practice 3 Act of 1994 is amended by changing Section 14 as follows: 4 (225 ILCS 115/14) (from Ch. 111, par. 7014) 5 Sec. 14. Fees. The Department shall provide by rule for 6 a schedule of fees for the administration and enforcement of 7 this Act, including but not limited to original licensure, 8 renewal, and restoration. The fees shall be nonrefundable. 9 All fees collected under this Act shall be deposited into 10 the General Professions Dedicated Fund and shall be 11 appropriated to the Department for the ordinary and 12 contingent expenses of the Department in the administration 13 of this Act.The fees under this Act are as follows and are14not refundable:15(1) The fee for application for a veterinary license is16$100.17(2) The fee for application for a veterinary technician18certificate is $50.19(3) In addition to the application fee, applicants for20the examination shall be required to pay, either to the21Department or to the designated testing service, a fee22covering the cost of determining an applicant's eligibility23and providing the examination. Failure to appear for the24examination on the scheduled date, at the time and place25specified, after the applicant's application and fee for26examination has been received and acknowledged by the27Department or the designated testing service, shall result in28the forfeiture of the fee.29(4) The fee for the renewal of a veterinary license30shall be $50 per year.31(5) The fee for the renewal of a veterinary technician32certificate is $25 per year.HB2644 Enrolled -10- LRB9101612ACmb 1(6) The fee for the reinstatement of a license or2certificate that has expired for not more than 5 years is3$10, plus payment of all unpaid fees for every year that has4lapsed, except as provided in subsection (7) of this Section.5(7) The fee for the restoration of a veterinary license6that has expired for more than 5 years is $300.7(8) The fee for the restoration of a veterinary8technician certificate that has expired for more than 5 years9is $150.10(9) The fee for the issuance of a duplicate license, for11the issuance of a replacement license that has been lost or12destroyed, or for the issuance of a license with a change of13name or address, other than during the renewal period, is14$20. No fee is required for name and address changes on15Department records when no duplicate license is issued.16(10) The fee for a certification of a license or17certificate for any purpose is $20.18(11) The fee to have the scoring of an examination19administered by the Department reviewed and verified is $20,20plus any fee charged by the testing service.21(12) The fee for a wall license shall be the actual cost22of producing such license.23(13) The fee for a roster of persons licensed as24veterinarians or veterinary technicians shall be the actual25cost of producing the roster.26(14) The fee for application for a license by a27veterinarian registered or licensed under the laws of another28jurisdiction is $100.29(15) The fee for application for a certificate by a30veterinary technician registered or licensed under the laws31of another jurisdiction is $50.32 (Source: P.A. 88-424.) 33 Section 35. The Interior Design Profession Title Act is HB2644 Enrolled -11- LRB9101612ACmb 1 amended by changing Sections 11 and 30 as follows: 2 (225 ILCS 310/11) (from Ch. 111, par. 8211) 3 Sec. 11. Fees. The Department shall provide by rule for 4 a schedule of fees for the administration and enforcement of 5 this Act, including but not limited to original licensure, 6 renewal, and restoration. The fees shall be nonrefundable. 7 All fees collected under this Act shall be deposited into 8 the General Professions Dedicated Fund and shall be 9 appropriated to the Department for the ordinary and 10 contingent expenses of the Department in the administration 11 of this Act.The following fees are not refundable:12(a) Registration fees.13(1) The fee for application for a certificate of14registration as an interior designer or a residential15interior designer is $100.16(2) The fee for a certificate of registration as an17interior designer or residential interior designer for a18person who is registered or licensed under the laws of19another state, or territory of the United States or of a20foreign country or province is $100.21(3) The fee for the renewal of a certificate of22registration shall be calculated at a rate of $80 per23year.24(4) The fee for the restoration of a certificate of25registration other than from inactive status is $20 plus26payment of all lapsed renewal fees.27(b) General fees.28(1) The fee for the issuance of a duplicate29certificate of registration, for the issuance of a30replacement certificate of registration, for a31certificate of registration which has been lost or32destroyed, or for the issuance of a certificate of33registration with a change of name or address other thanHB2644 Enrolled -12- LRB9101612ACmb 1during the renewal period is $20. No fee is required for2name and address changes on Department records when no3duplicate certificate of registration is issued.4(2) The fee for the certification of the5registrant's record for any purpose is $20.6(3) The fee for rescoring an examination is the7cost to the Department of rescoring the examination plus8any fees charged by the applicable testing service to9have the examination rescored.10(4) The fee for a wall certificate showing11registration shall be the actual cost of producing such12certificate.13(5) The fee for a roster of persons registered as14interior designers or residential interior designers in15this State shall be the actual cost of producing such a16roster.17 (Source: P.A. 87-756; 88-650, eff. 9-16-94.) 18 (225 ILCS 310/30) (from Ch. 111, par. 8230) 19 Sec. 30. Interior Design Administration and Investigation 20 Fund. All of the fees collected pursuant to this Act shall be 21 deposited into the General Professions Dedicated Fund. 22 On January 1, 2000 the State Comptroller shall transfer 23 the balance of the monies in the Interior Design 24 Administration and Investigation Fund into the General 25 Professions Dedicated Fund. Amounts appropriated for fiscal 26 year 2000 out of the Interior Design Administration and 27 Investigation Fund may be paid out of the General Professions 28 Dedicated Fund. 29 The monies deposited in the General Professions Dedicated 30 Fund may be used for the expenses of the Department in the 31 administration of this Act. 32All of the fees collected under this Act shall be deposited33in the Interior Design Administration and Investigation Fund.HB2644 Enrolled -13- LRB9101612ACmb 1The monies deposited in the Interior Design Administration2and Investigation Fund shall be appropriated to the3Department for expenses of the Department and the Board in4the administration of this Act. Monies in the Interior5Design Administration and Investigation Fund may be invested6and reinvested, with all earnings received from such7investment to be deposited in the Interior Design8Administration and Investigation Fund and used for the same9purposes as fees deposited in the Fund.10 Moneys from the Fund may also be used for direct and 11 allocable indirect costs related to the public purposes of 12 the Department of Professional Regulation. Moneys in the 13 Fund may be transferred to the Professions Indirect Cost Fund 14 as authorized by Section 61e of the Civil Administrative Code 15 of Illinois. 16 Upon the completion of any audit of the Department as 17 prescribed by the Illinois State Auditing Act that includes 18 an audit of the Interior Design Administration and 19 Investigation Fund, the Department shall make the audit open 20 to inspection by any interested person. The copy of the audit 21 report required to be submitted to the Department by this 22 Section is in addition to copies of audit reports required to 23 be submitted to other State officers and agencies by Section 24 3-14 of the Illinois State Auditing Act. 25 (Source: P.A. 89-204, eff. 1-1-96.) 26 Section 40. The Collection Agency Act is amended by 27 changing Section 8a as follows: 28 (225 ILCS 425/8a) (from Ch. 111, par. 2011a) 29 Sec. 8a. Fees. The Department shall provide by rule for a 30 schedule of fees for the administration and enforcement of 31 this Act, including but not limited to original licensure, 32 renewal, and restoration. The fees shall be nonrefundable. HB2644 Enrolled -14- LRB9101612ACmb 1 All fees collected under this Act shall be deposited into 2 the General Professions Dedicated Fund and shall be 3 appropriated to the Department for the ordinary and 4 contingent expenses of the Department in the administration 5 of this Act.The following fees shall be paid to the6Department for the licensing and registration functions7performed by the Department under this Act:8(1) The fee to be paid by an applicant for a9certificate of registration as a collection agency is10$750.11(2) The fee to be paid upon the renewal of a12certificate of registration as a collection agency is13$750 for a 3-year renewal.14(3) The fee to be paid for the issuance of a15duplicate certificate of registration, for the issuance16of a replacement certificate for a certificate which has17been lost or destroyed or for the issuance of a18certificate with a change of name or address other than19during the renewal period is $20.20(4) The fee to be paid for a certification of a21registrant's record for any purpose is $20.22(5) The fee to be paid by a registrant for a wall23certificate showing his registration shall be the actual24cost of producing such certificate.25(6) The fee to be paid for a roster of persons26registered as collection agencies in this State shall be27the actual cost of producing such a roster.28(7) The fee to be paid to the Department for a29printed copy of this Act and of the rules and regulations30promulgated for the administration of this Act is $1.31(8) The fee to be paid by an applicant for a32certificate of registration to operate a branch office is33$250.34(9) The fee to be paid upon the renewal of aHB2644 Enrolled -15- LRB9101612ACmb 1certificate of registration to operate a branch office is2$150 for a 3-year renewal.3All fees and fines collected under this Act shall be4deposited into the General Professions Dedicated Fund. All5monies in the fund shall be used by the Department of6Professional Regulation, as appropriated, for the ordinary7and contingent expenses of the Department.8Any person who delivers a check or other payment to the9Department that is returned to the Department unpaid by the10financial institution upon which it is drawn shall pay to the11Department, in addition to the amount already owed to the12Department, a fine of $50. If the check or other payment was13for a renewal or issuance fee and that person practices14without paying the renewal fee or issuance fee and the fine15due, an additional fine of $100 shall be imposed. The fines16imposed by this Section are in addition to any other17discipline provided under this Act for unlicensed practice or18practice on a nonrenewed license. The Department shall notify19the person that payment of fees and fines shall be paid to20the Department by certified check or money order within 3021calendar days of the notification. If, after the expiration22of 30 days from the date of the notification, the person has23failed to submit the necessary remittance, the Department24shall automatically terminate the license or certificate or25deny the application, without hearing. If, after termination26or denial, the person seeks a license or certificate, he or27she shall apply to the Department for restoration or issuance28of the license or certificate and pay all fees and fines due29to the Department. The Department may establish a fee for the30processing of an application for restoration of a license or31certificate to pay all expenses of processing this32application. The Director may waive the fines due under this33Section in individual cases where the Director finds that the34fines would be unreasonable or unnecessarily burdensome.HB2644 Enrolled -16- LRB9101612ACmb 1 (Source: P.A. 89-387, eff. 1-1-96.) 2 Section 50. The Detection of Deception Examiners Act is 3 amended by changing Section 26 as follows: 4 (225 ILCS 430/26) (from Ch. 111, par. 2427) 5 Sec. 26. Fees. The Department shall provide by rule for a 6 schedule of fees for the administration and enforcement of 7 this Act, including but not limited to original licensure, 8 renewal, and restoration. The fees shall be nonrefundable. 9 All fees collected under this Act shall be deposited into 10 the General Professions Dedicated Fund and shall be 11 appropriated to the Department for the ordinary and 12 contingent expenses of the Department in the administration 13 of this Act.The following fees shall be paid to the14Department for the licensing and registration functions15performed by the Department under this Act and shall be16nonrefundable:17(A) License as detection of deception examiner.18(1) The fee for application and for a license as a19detection of deception examiner is $25.20(2) In addition, applicants for any examination shall be21required to pay, either to the Department or to the22designated testing service, a fee covering the cost of23determining the applicant's eligibility and providing the24examination.25(3) The fee upon the renewal of a license as a detection26of deception examiner shall be calculated at the rate of $9027per year.28(4) The fee for the reinstatement of a license as a29detection of deception examiner which has expired for not30more than 5 years is $10 plus all lapsed renewal fees.31(5) The fee for the restoration of a license as a32detection of deception examiner which has expired for moreHB2644 Enrolled -17- LRB9101612ACmb 1than 5 years is $10 plus all lapsed renewal fees.2(B) General Fees.3(1) The fee for the issuance of a duplicate license, for4the issuance of a replacement license for a license which has5been lost or destroyed or for the issuance of a certificate6with a change of name or address other than during the7renewal period is $10.8(2) The fee for a certification of a licensee's record9for any purpose is $10.10(3) The fee to have the scoring of an examination11administered by the Department reviewed and verified is $1012plus any fees charged by the applicable testing service.13(4) The fee for a licensee for a wall certificate shall14be the actual cost of producing such certificate.15(5) The fee for a roster of persons licensed as16detection of deception examiners and registered to study17detection of deception in this State shall be the actual cost18of producing such a roster.19This Section in regard to fees shall not apply to any20examiner in the exclusive employment of the United States of21America, the State of Illinois, any County, municipality, or22political subdivision in this State, any Department, Bureau23or Agency of any of the foregoing, or any examiner thereof in24the pursuit of his official duties.25 (Source: P.A. 84-1235.) 26 Section 55. The Private Detective, Private Alarm, 27 Private Security, and Locksmith Act of 1993 is amended by 28 changing Section 105 as follows: 29 (225 ILCS 446/105) 30 Sec. 105. Issuance of license; renewal, fees. 31 (a) The Department shall, upon the applicant's 32 satisfactory completion of the requirements authorized under HB2644 Enrolled -18- LRB9101612ACmb 1 this Act, and upon receipt of the requisite fees, issue the 2 appropriate license and wallet card showing the name and 3 business location of the licensee and the dates of issuance 4 and expiration, and containing a photograph of the licensee 5 provided to the Department that is not more than one year old 6 as of the date of application for licensure and reflects any 7 recent appearance changes. 8 (b) An applicant may upon satisfactory completion of 9 requirements authorized under this Act, and upon receipt of 10 requisite fees related to the application and testing for 11 licensure under this Act, elect to defer the issuance of the 12 applicant's initial license for a period not longer than 6 13 years. Any applicant who fails to request issuance of their 14 initial license or agency certificate and remit the fees 15 associated with that license within 6 years shall be required 16 to resubmit an applicant for licensure together with all 17 required fees. 18 (c) The expiration date, renewal period, and conditions 19 for renewal and restoration of each license, agency 20 certificate of registration, permanent employee registration 21 card, and firearm authorization card issued under this Act 22 shall be set by rule of the Department. The holder may renew 23 the license, agency certificate of registration, permanent 24 employee registration card, or firearm authorization card 25 during the month preceding its expiration by paying the 26 required fee and by meeting those conditions that the 27 Department may specify. Any license holder who notifies the 28 Department in writing, on forms prescribed by the Department, 29 may elect to place his or her license on an inactive status 30 for a period of no longer than 6 years and shall, subject to 31 the rules of the Department, be excused from payment of 32 renewal fees until he or she notifies the Department in 33 writing of a desire to resume active status. Practice while 34 on inactive status constitutes unlicensed practice. A HB2644 Enrolled -19- LRB9101612ACmb 1 nonrenewed license that has lapsed for less than 6 years may 2 be restored upon payment of a $50 restoration fee plus all 3 lapsed renewal fees. A license that has lapsed for more than 4 6 years may be restored by paying the required fees specified 5 in this Section and by providing evidence of competence to 6 resume practice satisfactory to the Department and the Board, 7 which may include passage of the written examination. All 8 restoration fees and lapsed renewal fees shall be waived for 9 an applicant whose license lapsed while on active duty in the 10 military provided application for restoration is made within 11 one year after discharge from the service. 12 (d) The Department shall provide by rule for a schedule 13 of fees for the administration and enforcement of this Act, 14 including but not limited to original licensure, renewal, and 15 restoration. The fees shall be nonrefundable. 16 All fees collected under this Act shall be deposited into 17 the General Professions Dedicated Fund and shall be 18 appropriated to the Department for the ordinary and 19 contingent expenses of the Department in the administration 20 of this Act.The nonrefundable fees are as follows:21(1) The filing fee for the first examination is $2522plus the cost of determining an applicant's eligibility23and of providing the examination; subsequent examination24fees shall be the cost of the examination; the fee for25the examination shall be paid to the Department or its26designee.27(2) The initial issuance of any individual license28or agency certificate shall be $500.29(3) The initial issuance of a branch office30certificate is $200.31(4) The license issued to an applicant licensed in32another state or foreign country on the basis of33endorsement is $500.34(5) The triennial renewal of any individual licenseHB2644 Enrolled -20- LRB9101612ACmb 1or agency certificate is $450.2(6) The triennial renewal of a branch office3certificate is $200.4(7) The reinstatement of a license that has been5lapsed for less than 6 years is $50, plus all lapsed6renewal fees.7(8) The restoration of a lapsed license that has8been lapsed for more than 6 years is $100, plus all9lapsed renewal fees.10(9) The issuance of a duplicate license, agency11certificate of registration, permanent employee12registration card, certification of completion of 20-Hour13Basic Training, Certification of Firearm Training,14Firearm Authorization Card, or a certificate issued for a15change of name or address other than during the renewal16period is $25.17(10) The issuance of a permanent employee18registration card is $55; the triennial renewal of the19card is $45.20(11) The issuance of a firearm authorization card21is $55.22(12) The triennial renewal for a Firearm23Authorization Card is $45; reissuance of a Firearm24Authorization Card to an agency that has changed its name25is $10.00.26(13) For processing a fingerprint card by the State27Police the fee is the cost of processing, which shall be28made payable to the State Police Services Fund and shall29be remitted to the State Police for deposit into the30Fund.31(14) For review and verification of the scoring of32an examination administered by the Department, $20 plus33any actual fees charged by the testing service.34(15) For a roster of licensees or registrants theHB2644 Enrolled -21- LRB9101612ACmb 1fee shall be the cost of producing a roster.2(16) The fee for issuance of certification of a3license record shall be $20.4(17) The fee for issuance and renewal of an armed5proprietary security force registration is $20.6(18) The fee for reinstatement of a license from7inactive status that has lapsed for a period less than 68years shall be the same as the current renewal fee.9 (Source: P.A. 88-363.) 10 Section 99.
