91_HB2716 LRB9105544DJcd 1 AN ACT to amend the Fireworks Use Act by changing Section 2 5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Fireworks Use Act is amended by changing 6 Section 5 as follows: 7 (425 ILCS 35/5) (from Ch. 127 1/2, par. 131) 8 Sec. 5. Violations; penalties. 9 (a) Any person, firm, co-partnership, or corporation 10 violating the provisions of this Act, except as provided in 11 subsection b, shall be guilty of a Class B misdemeanor. 12 (b) The possession, offering for sale, exposing for 13 sale, or selling at retail of fireworks in violation of this 14 Act is: 15 (1) a petty offense if involving up to 1 pound of 16 fireworks, exclusive of external packaging; or 17 (2) a Class B misdemeanor if involving an amount 18 greater than 1 pound but up to 3 pounds of fireworks, 19 exclusive of external packaging; or 20 (3) a Class A misdemeanor if involving an amount 21 greater than 3 pounds of fireworks, exclusive of external 22 packaging. 23 "External packaging", for purposes of this subsection, 24 shall mean any materials which are not an integral part of 25 the operative unit of fireworks. 26 (Source: P.A. 82-620.)
