91_HB2758eng HB2758 Engrossed LRB9102496PTpk 1 AN ACT to amend the Public Radio and Television Grant Act 2 by changing Sections 6 and 7 and adding Section 7.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Radio and Television Grant Act is 6 amended by changing Sections 6 and 7 and adding Section 7.5 7 as follows: 8 (30 ILCS 745/6) (from Ch. 127, par. 1556) 9 Sec. 6. Grant Limitations. Notwithstanding any other 10 provision of this Act, except Section 7.5, no station shall 11 in any year be allocated funds under this Act in excess of 12 one-half of its actual operating cost for the prior fiscal 13 year. Grants provided under Section 7.5 shall be disregarded 14 in computing this limitation. Those funds not obligated by 15 virtue of this limitation shall be distributed to the 16 remaining stations in accordance with the provisions of 17 Section 5 of this Act. 18 Notwithstanding any other provision of this Act, no 19 station shall be allocated more than 60% of all funds in its 20 grant pool. Those funds not obligated by virtue of this 21 limitation shall be distributed to the remaining eligible 22 stations in accordance with the provisions of Section 5 of 23 this Act. 24 (Source: P.A. 84-1040.) 25 (30 ILCS 745/7) (from Ch. 127, par. 1557) 26 Sec. 7. Required Assurances. Except for grants provided 27 under Section 7.5 of this Act, each eligible station and its 28 station licensee shall certify to the State Comptroller when 29 applying for grant funds under this Act that any funds 30 received pursuant to the provisions of this Act shall not HB2758 Engrossed -2- LRB9102496PTpk 1 supplant or cause to be reduced any other sources of funding 2 for such stations, and will be used solely for the benefit of 3 a public broadcasting station and not for general 4 institutional overhead or parent organization expenses. 5 (Source: P.A. 84-1040.) 6 (30 ILCS 745/7.5 new) 7 Sec. 7.5. Digital capability grants. Eligible 8 television stations shall receive grants in equal amounts to 9 be used solely to attain the digital capability required by 10 federal law. Grant moneys received under this Section that 11 are not expended before December 31, 2003 shall be paid into 12 the General Revenue Fund. 13 Section 99. Effective date. This Act takes effect upon 14 becoming law.
