91_HB2759 LRB9104543NTsb 1 AN ACT concerning tuition at public institutions of 2 higher education. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 1. Short title. This Act may be cited as the 6 Access to College Education Act. 7 Section 5. Definition. As used in this Act "public 8 institution of higher education" has the meaning ascribed to 9 it in Section 1 of the Board of Higher Education Act, except 10 that it does not include any public community college of this 11 State. 12 Section 10. Access to College Education. 13 Notwithstanding any other law of this State, the governing 14 board of a public institution of higher education shall not 15 increase or authorize an increase in the rate of 16 undergraduate or graduate tuition charged at any campus of a 17 university under its jurisdiction for any period of any 18 academic year that begins on or after the effective date of 19 this Act if that tuition increase exceeds the annual cost of 20 living index as determined by the U.S. Department of 21 Agriculture without approval and a supplemental 22 appropriation, for the amount proposed that exceeds the 23 annual cost of living, by the General Assembly. 24 Section 95. The Board of Higher Education Act is amended 25 by changing Section 10 as follows: 26 (110 ILCS 205/10) (from Ch. 144, par. 190) 27 Sec. 10. The Board of Trustees of the University of 28 Illinois, the Board of Trustees of Southern Illinois -2- LRB9104543NTsb 1 University, the Board of Trustees of Chicago State 2 University, the Board of Trustees of Eastern Illinois 3 University, the Board of Trustees of Governors State 4 University, the Board of Trustees of Illinois State 5 University, the Board of Trustees of Northeastern Illinois 6 University, the Board of Trustees of Northern Illinois 7 University, the Board of Trustees of Western Illinois 8 University, and the Illinois Community College Board shall 9 retain all the powers and duties heretofore given and 10 conferred upon them by statute, except insofar as they are 11 limited by the powers and duties delegated to the Board of 12 Higher Education by this Act. 13 Nothing, however, in this Act shall be construed to 14 prevent individual state universities and colleges from 15 establishing higher minimum admission requirements and higher 16 minimum admission requirements may be established for 17 out-of-state students than for Illinois residents. Each 18 public university is subject to the Access to Education Act. 19 (Source: P.A. 89-4, eff. 1-1-96.) 20 Section 99. Effective date. This Act takes effect upon 21 becoming law.
