91_HB2850 LRB9104665RCks 1 AN ACT to amend the Criminal Code of 1961 by adding 2 Section 33D-5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 adding Section 33D-5 as follows: 7 (720 ILCS 5/33D-5 new) 8 Sec. 33D-5. Juvenile gang members; guardian liability. 9 (a) A parent or legal guardian of a minor under 17 years 10 of age who knows or who reasonably should know that the minor 11 is a member of a gang and the minor commits an act in 12 furtherance of gang activity that constitutes an offense if 13 committed by an adult is guilty of a business offense and may 14 be fined not exceeding $10,000, sentenced to serve a period 15 of 6 months conditional discharge, or a parental workshop 16 established by the probation or court services department of 17 the county or a combination of any of these sentences. Each 18 act of delinquency committed by the minor under 17 years of 19 age with knowledge of the parent or guardian or in which the 20 parent or guardian should reasonably be aware constitutes a 21 separate offense. 22 (b) In this Section, "gang" has the meaning ascribed to 23 it in Section 10 of the Illinois Streetgang Terrorism Omnibus 24 Prevention Act.
