91_HB2932 LRB9109101EGfg 1 AN ACT in relation to farmer retraining. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Department of Agriculture Law of the 5 Civil Administrative Code of Illinois is amended by adding 6 Section 205-435 as follows: 7 (20 ILCS 205/205-435 new) 8 (Section scheduled to be repealed on January 1, 2005) 9 Sec. 205-435. Farmer retraining program. 10 (a) The Department of Agriculture shall contract with an 11 association or other entity that represents Illinois farmers 12 to establish and operate a program of retraining for current 13 and former Illinois farmers who have left or are planning to 14 leave the profession of farming. 15 (b) The entity chosen to operate the program shall 16 undertake an assessment of needs and opportunities by area 17 throughout the State and shall conduct or provide for 18 counseling and retraining as may be appropriate in the 19 various areas of this State. 20 (c) The costs of the program, including any related 21 administrative expenses of the Department, may be paid from 22 any funds specifically appropriated or otherwise available to 23 the Department for that purpose. The Department may pay the 24 costs of the program by making grants to the operating 25 entity, by making grants directly to service providers, by 26 paying reimbursements for services provided, or in any other 27 appropriate manner. The Department may also provide 28 counseling and retraining services directly as a part of this 29 program or any other Department program. 30 (d) The Department has the power to enter into any 31 agreements that are necessary or appropriate for the -2- LRB9109101EGfg 1 establishment, operation, and funding of the program. The 2 Department may adopt any rules, including emergency rules, 3 that it determines to be necessary or appropriate for the 4 establishment, operation, and funding of the program. 5 (e) The General Assembly finds that the need for farmer 6 retraining in this State is substantial and likely to 7 increase significantly in the near future; for this reason 8 the Department is encouraged to initiate the program provided 9 for in this Section as quickly as may be practical. 10 (f) The progam is abolished and this Section is repealed 11 on January 1, 2005. 12 Section 99. Effective date. This Act takes effect upon 13 becoming law.
