1 AN ACT to amend the Public Utilities Act by changing
2 Section 7-104.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Utilities Act is amended by
6 changing Section 7-104 as follows:
7 (220 ILCS 5/7-104) (from Ch. 111 2/3, par. 7-104)
8 Sec. 7-104. Proceedings before Commission. In a
9 proceeding before the Commission in which the consent and
10 approval of the Commission to the sale, lease or other
11 disposition of any real property owned by a public utility is
12 sought, any tenant in possession who has been in possession
13 of such property for more than 5 years and who has made
14 substantial improvements to the property has standing to
15 appear and offer evidence to the Commission with respect to
16 the proposed disposition, and the Commission, in making its
17 determination, shall consider the rights and equities of such
18 tenant in possession.
