1 AN ACT to amend the Gas Transmission Facilities Act by
2 changing Section 4.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Gas Transmission Facilities Act is
6 amended by changing Section 4 as follows:
7 (220 ILCS 25/4) (from Ch. 111 2/3, par. 574)
8 Sec. 4. Interconnection cost; payment. The private
9 energy entity shall be required to provide and to pay the
10 total cost of the interconnection as well as any costs
11 associated with providing a transmission capacity sufficient
12 to handle that portion of the natural gas provided by the
13 private energy entity that is over and above the capacity
14 otherwise required by the public utility to service its
15 utility customers and meet other authorized commitments. The
16 public utility shall not be required to construct any
17 additional gas facility on a system or to acquire any real
18 property by eminent domain or otherwise for such facilities,
19 in order to perform the service contemplated by this Act
20 unless the costs of such additional facilities or
21 acquisitions are to be borne by the private energy entity.
