91_HB3062 LRB9110140MWgc 1 AN ACT concerning medical expenses of prisoners in county 2 jails, amending Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Counties Code is amended by adding 6 Section 3-15017 as follows: 7 (55 ILCS 5/3-15017 new) 8 Sec. 3-15017. Reimbursement of medical expenses. Medical 9 expenses incurred by the county on behalf of a person 10 confined in a county jail that are not recovered from (i) the 11 confined person on whose behalf the expenses are incurred or 12 that person's insurance carrier or (ii) the Arrestee's 13 Medical Costs Fund may be recovered from the Department of 14 Corrections. The county must apply to the Department for 15 reimbursement for those costs under Section 3-2-2.3 of the 16 Unified Code of Corrections. 17 Section 10. The Unified Code of Corrections is amended by 18 adding Section 3-2-2.3 as follows: 19 (730 ILCS 5/3-2-2.3 new) 20 Sec. 3-2-2.3. Reimbursement of county prisoner medical 21 expenses. 22 (a) The Department, out of moneys appropriated for that 23 purpose from the General Revenue Fund, shall reimburse 24 counties for medical expenses incurred on behalf of persons 25 confined in county jails. A county may recover expenses 26 under this Section only to the extent that the county's costs 27 are not recovered from (i) the confined person on whose 28 behalf the expenses are incurred or that person's insurance 29 carrier or (ii) the Arrestee's Medical Costs Fund. The county -2- LRB9110140MWgc 1 seeking reimbursement of expenses under this Section shall 2 apply to the Department of Corrections, on a form furnished 3 by the Department. 4 (b) The Director shall adopt rules to implement this 5 Section. 6 Section 15. The County Jail Act is amended by adding 7 Section 17.6 as follows: 8 (730 ILCS 125/17.6 new) 9 Sec. 17.6. Recovery of expenses not reimbursed from 10 other sources. Medical expenses incurred on behalf of a 11 person confined in a county jail that are not recovered from 12 (i) the confined person or that person's insurance carrier or 13 (ii) the Arrestee's Medical Costs Fund may be recovered from 14 the Department of Corrections. The county must apply to the 15 Department for reimbursement for those costs under Section 16 3-2-2.3 of the Unified Code of Corrections.
