91_HB3574 LRB9110931NTks 1 AN ACT to amend the University of Illinois Trustees Act 2 by changing Section 1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The University of Illinois Trustees Act is 6 amended by changing Section 1 as follows: 7 (110 ILCS 310/1) (from Ch. 144, par. 41) 8 Sec. 1. Membership; terms; vacancies. The Board of 9 Trustees of the University of Illinois shall consist of 9 10 trustees appointed by the Governor, by and with the advice 11 and consent of the Senate, the Governor, and, until July 1, 12 2001, one voting student member designated by the Governor 13 from one campus of the University and one nonvoting student 14 member from each campus of the University not represented by 15 the voting student member. The Governor shall designate one 16 of the student members serving on the Board on the effective 17 date of this amendatory Act of 1997 to serve as the voting 18 student member for the remainder of that student's term on 19 the Board. Beginning on July 1, 2001, and thereafter, the 20 student members of the Board shall all be nonvoting members, 21 one selected from each campus of the University. 22 Each student member shall serve a term of one year, 23 beginning on July 1 of each year or on the date of his or her 24 selection, whichever is later, and expiring on the next 25 succeeding June 30. The student members shall have all of 26 the privileges of membership, including the right to make and 27 second motions and to attend executive sessions, other than 28 the right to vote, except that until July 1, 2001 the student 29 member designated by the Governor as the voting student 30 member shall have the right to vote on all Board matters 31 except those involving faculty tenure, faculty promotion or -2- LRB9110931NTks 1 any issue on which the student member has a direct conflict 2 of interest. The method of selecting these student members 3 shall be determined by campus-wide student referendum, and 4 any student designated by the Governor to be a voting student 5 member shall be one of the students selected by this method. 6 A student member who is not entitled to vote on a measure at 7 a meeting of the Board or any of its committees shall not be 8 considered a member for the purpose of determining whether a 9 quorum is present at the time that measure is voted upon. 10 To be eligible for selection as a student member and to be 11 eligible to remain as a voting or nonvoting student member of 12 the Board, a student member must be a resident of this State, 13 must have and maintain a grade point average that is 14 equivalent to at least 2.5 on a 4.0 scale, and must be a full 15 time student enrolled at all times during his or her term of 16 office except for that part of the term which follows the 17 completion of the last full regular semester of an academic 18 year and precedes the first full regular semester of the 19 succeeding academic year at the university (sometimes 20 commonly referred to as the summer session or summer school). 21 If a voting or nonvoting student member serving on the Board 22 fails to continue to meet or maintain the residency, minimum 23 grade point average, or enrollment requirement established by 24 this Section, his or her membership on the Board shall be 25 deemed to have terminated by operation of law. 26 The term of each elected trustee who is in office on the 27 effective date of this amendatory Act of 1995 shall terminate 28 on the second Monday in January, 1996, or when a quorum of 29 the trustees initially to be appointed under this amendatory 30 Act of 1995 is appointed and qualified, whichever last 31 occurs. 32 No more than 5 of the 9 trustees appointed by the 33 Governor shall be affiliated with the same political party. 34 The term of office of each appointed trustee shall be 6 years -3- LRB9110931NTks 1 from the third Monday in January of each odd numbered year, 2 except that of the 9 trustees initially appointed by the 3 Governor, 3 shall be appointed for terms that commence on the 4 date of their appointment and expire on the second Monday in 5 January, 1997; 3 shall be appointed for terms that commence 6 on the date of their appointment and expire on the second 7 Monday in January, 1999; and 3 shall be appointed for terms 8 that commence on the date of their appointment and expire on 9 the second Monday in January, 2001. Upon expiration of the 10 terms of the members initially appointed by the Governor, 11 their respective successors shall be appointed for terms of 6 12 years from the second Monday in January of each odd numbered 13 year and until their respective successors are appointed and 14 qualified. 15 Vacancies shall be filled for the unexpired term in the 16 same manner as original appointments. If a vacancy in 17 membership occurs at a time when the Senate is not in 18 session, the Governor shall make temporary appointments until 19 the next meeting of the Senate, when he shall appoint persons 20 to fill such memberships for the remainder of their 21 respective terms. If the Senate is not in session when 22 appointments for a full term are made, appointments shall be 23 made as in the case of vacancies. 24 No action of the board shall be invalidated by reason of 25 any vacancies on the board, or by reason of any failure to 26 select student members. 27 (Source: P.A. 89-4, eff. 7-1-95 (eff. date changed from 28 1-1-96 by P.A. 89-24); 89-5, eff. 1-1-96; 90-630, eff. 29 7-24-98.)
